In consideration of permission for my dog to participate in a training program, and for other good and valuable consideration, the receipt of which is hereby acknowledged by me, I agree to the following:
As the owner of the above-referenced dog(s), I desire for my dog to participate in a certain training program with VanNuil Canine, LLC, a Michigan limited liability company (the “Company”). I understand that the Company will only allow my dog to participate if I accept and agree to be bound by the terms and conditions set forth in this Waiver of Liability (this “Waiver”). The information set forth above about me and my dog is true, accurate, and complete. By signing this form, I agree to participate in a training program with the Company.
Voluntary Assumption of Risk
I acknowledge and agree that my dog(s) will be training in an environment where they will be socializing and interacting with people and other dogs of all sizes. I further acknowledge and agree that all animal training activities contain inherent risks, including the risk of loss, injury, or death. I accept and assume all risks of my participation and my dog’s participation in such training activities and assume full responsibility for any loss, injury, death, or damage arising in connection with such participation, including, but not limited to, any loss, injury, or death arising from the transportation to or from any veterinary clinic or training venue.
Release of Liability; Indemnification
I agree not to sue the Company, or any of its volunteers, employees, contractors, members, or managers, (collectively, the “Released Parties”) in respect of, and hereby forever release them from any and all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with my or my dog’s participation in any training program, including but not limited to: (1) temporary or permanent disability; (2) death; (3) any emotional distress; (4) any loss of services, financial support, aid, consortium, or companionship; and (5) any damage to or loss of property. This Waiver applies even if the loss or injury complained of was caused in whole or in part by the omissions, conduct, and/or negligence of any one or more of the Released Parties.
I agree to defend, indemnify, and hold the Released Parties harmless from and against any actual or threatened liability, loss, claims, demands, causes of action, proceedings, judgments, costs, expenses, and damages, including but not limited to actual attorney’s fees, arising out of, related to, or incident to the actions of myself or my dog. I will assume all liability for the actions of my dog, including any dog bites. Without limiting the foregoing, my obligation to defend, indemnify, and hold the Released Parties harmless shall apply to any actual or threatened liability, loss, claims, demands, causes of action, proceedings, judgments, costs, expenses, and damages, including but not limited to actual attorney’s fees, asserted by any third party or my family members, dependents, or heirs.
Without limiting the generality of the preceding paragraphs, by signing this Waiver, I hereby acknowledge and agree that I will adhere to the State of Michigan Liability of Owner for Dog Bite Statute, MCL 287.351, which provides, in part, that if a dog bites a person, without provocation while the person is on public property, or lawfully on private property, including the property of the owner of the dog, the owner of the dog shall be liable for any damages suffered by the person bitten, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.
Hold Harmless
I understand that working with dogs may entail certain risks of personal injury to myself or my dog(s). I hereby acknowledge my voluntary and informed assumption of full responsibility and liability regarding any injuries that I or my dog may incur coincident to my participation with VanNuil Canine, LLC. I hereby assume any and all risks associated therewith and expressly waive, release, discharge and hold harmless VanNuil Canine, its members, agents, employees and assigns from and against any and all liability for loss, damage, injury, illness or claim of any nature whatsoever, however caused, arising out of, in association with, or related in any way to my involvement with its services.
Illness or Injury
In the event my dog becomes ill or sustains injury, I hereby irrevocably provide my permission to the Company and its employees and contractors to take whatever steps they deem necessary in their sole discretion to obtain medical treatment for my dog. I agree to pay any and all charges or fees incurred with respect to such treatment. I consent to any veterinarian being retained to render care for my dog. I agree to pay for any and all charges and fees incurred with respect to any medical treatment on the day I pick up my dog(s), and I understand that my dog(s) may not leave the Company’s premises until such time as all charges or fees are paid in full. I understand that any animal left for ten (10) days beyond the estimated date of pick-up without payment or contact will be considered abandoned and the owner relinquishes responsibility and ownership after such time.
Right to Decline
I understand that the Company reserves the right to decline to allow me or my dog to participate in any training activities at any time, for any or no reason.
Binding Effect
I acknowledge that all terms and conditions provided herein are binding upon me, my family members, dependents, estate, heirs, successors, and legal personal representatives. I agree that any claim or dispute arising out of or relating to this Waiver, the dog’s participation in the training program, or my relationship with the Company will be resolved in the courts of Kent County, Michigan and will be governed by Michigan law.
Breadth and Inclusivity
I agree that this Waiver is intended to be as broad and inclusive as is permitted by the laws of the State of Michigan and the United States of America. I further agree that if any portion of this Waiver is held invalid, the remaining provisions of the Waiver shall continue in full legal force and effect.
I have read each and every paragraph in this document. I am 18 years of age or older. I am entering into this Waiver on behalf of myself, my spouse or domestic partner, my child(ren), and our respective and/or collective issue, parents, siblings, heirs, assigns, personal representatives, estate(s), and anyone else who can claim by or through such person or persons. I represent and warrant that I am the owner of the above listed dog(s) and have the authority to execute this Waiver.
Photo and Video Release
I give VanNuil Canine, LLC, or any of its volunteers, employees, contractors, members, or managers permission to publish in print, electronic, or video format the likeness or image of myself or my dog(s). I release all claims against VanNuil Canine, LLC, or any of its volunteers, employees, contractors, members, or managers with respect to privacy rights, publicity rights, copyright ownership and publication, including any claim for compensation related to the use of the materials.
Cancellation Policy
Group Classes: Payment is required to reserve your spot in a group class. Group class cancellations with a refund minus a 10% processing fee are only allowed more than 7 days prior to the start date of a group class. Refunds will not be given for any missed classes due to personal reasons. Classes postponed due to weather or trainer absence will be rescheduled.
Workshops: Payment is required to reserve your spot in a workshop. Cancellations prior to 7 days prior to the workshop wil recieve a refund. Cancellations less than 7 days prior will recieve a refund only if I can fill your spot. Workshops postponed due to weather or trainer absence will be rescheduled or refunded.
Private Lessons: Payment is required to reserve your private lesson appointment. Cancellations more than 48hrs prior the scheduled lesson will be rescheduled or refunded. Cancellations less than 48hrs prior will not be refunded. Private lessons postponed due to weather or trainer absence will be rescheduled or refunded.
NOTICE: This is a legal document and releases certain of your rights. You should only sign this document if you have read it and agree to its terms.
