  • AI tools are showing up in legal workflows quickly, and the ethical rules governing how lawyers use them haven't changed just because the technology is new. Duties of competence, confidentiality, and supervision all come into play when attorneys use AI in their work, and how those duties apply isn't always obvious, especially in an in-house setting where legal teams work closely with business stakeholders.

In this webinar, Laura Frederic, Carolyn Elefant, and March Hoag will walk through the ethical obligations attorneys need to keep in mind when using AI tools. The discussion will address ABA Model Rules and related guidance that apply to AI use, and how those rules translate into practical guardrails for legal departments. Key topics include:

    • Duty of competence as it applies to understanding and using AI tools, including ABA Model Rule 1.1 and its comments on technology
    • Confidentiality risks when using AI tools that process client data, and obligations under ABA Model Rule 1.6 related to safeguarding client information
    • Supervisory duties under ABA Model Rules 5.1 and 5.3 when legal team members or business partners use AI to produce or contribute to work product
    • Building practical guardrails for legal departments, including AI use policies, review workflows, and approval processes that satisfy ethical obligations
