Boost Boxing & Fitness – Waiver and Release of Liability Agreement
IMPORTANT: THIS IS A LEGAL DOCUMENT. BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY BEFORE SIGNING.
This Waiver and Release of Liability Agreement ("Agreement") is entered into by the undersigned Participant (or Participant’s legal guardian if under 18) in favour of Boost Boxing & Fitness, its owners, officers, employees, trainers, contractors, volunteers, affiliates, agents, successors, insurers, landlords, and any related entities (collectively, the “Released Parties”).
1. Acknowledgment of Risks
The Participant acknowledges that boxing, fitness training, and all related activities—including but not limited to sparring, contact drills, weightlifting, cardiovascular training, circuit training, and conditioning—involve inherent risks, both known and unknown. These risks include but are not limited to:
Sprains, strains, lacerations, bruising
Broken bones, dislocations, concussions, or other traumatic brain injuries
Cardiac events, respiratory distress, dehydration
Permanent disability, paralysis, or death
Physical contact with instructors, equipment, or other participants
Equipment malfunction or improper use
The Participant voluntarily assumes all such risks, whether anticipated or not, and accepts full personal responsibility for any resulting injury, illness, or death.
2. Release of Liability
To the maximum extent permitted by law, the Participant, on behalf of themselves and their heirs, executors, administrators, assigns, and legal representatives, hereby:
Releases and forever discharges the Released Parties from any and all liability for injuries, illness, death, property damage, or economic loss arising out of or in connection with:
Participation in classes, sparring, or training;
Use of facilities or equipment;
Negligent acts or omissions of the Released Parties;
The condition of the premises or equipment;
Contact with other individuals or objects.
This release does not apply to claims arising from the gross negligence or intentional misconduct of the Released Parties, as prohibited under Australian Consumer Law.
3. Sparring and Contact Work
The Participant understands and acknowledges that sparring and contact boxing drills are high-risk, full-contact activities. Participation in sparring is voluntary, and the Participant expressly assumes all risks of injury or death associated with contact work, whether from protective gear failure, improper technique, or contact with other participants.
4. Medical Authorization and Financial Responsibility
The Participant certifies they are in good physical condition and have no known medical conditions that would impair their ability to participate safely. The Participant authorizes the Released Parties to seek emergency medical care in the event of an injury or medical episode and accepts full financial responsibility for any resulting costs. The Released Parties shall not be held responsible for any medical bills or related expenses.
5. Indemnification
The Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all liabilities, claims, actions, causes of action, costs, attorney fees, and expenses arising out of:
The Participant’s participation in activities at the facility;
Any injuries or damages caused by the Participant to themselves or others;
Any breach of this Agreement.
6. Media Release
The Participant grants permission to use photos, video, or audio of their participation for promotional, marketing, or commercial purposes. The Participant waives any right to compensation or ownership of such media.
7. Governing Law and Severability
This Agreement shall be governed by the laws of the state of New South Wales, Australia. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment and Entire Agreement
This Agreement represents the entire understanding between the parties. No oral representations, statements, or inducements apart from this written Agreement have been made. The Participant certifies that they have read and understand this Agreement in its entirety, and signs it voluntarily and without coercion.
