I hereby further authorize my employer that in case of termination of my employment, to deduct the balance outstanding together with other charges and expenses incurred on my account to East Africa Futures Company Ltd. on that day from my final salary payment, leave payment, bonus and other benefits excluding pension payment or any other payment that any written law in Kenya prohibits from being deducted.

I also understand that should I leave employment while my loan is outstanding, the facility will immediately assume commercial rates of interest.

READ THESE TERMS & CONDITIONS CAREFULLY

1. The offer letter is made open for acceptance within thirty days (30) from the date of this letter and if not accepted unconditionally within that period, it will be deemed to be withdrawn from expiry thereof.

2. It should be understood that the facility so granted is payable on demand in full at the option of East Africa Futures Company Ltd.

3. We reserve the right to combine accounts, the right to consolidate all securities held for any account to constitute for all accounts also held.

The continuance of this facility will depend upon your account being conducted to our satisfaction and on the understanding that the facility so granted is payable on demand in full should East Africa Futures Company Ltd. deem it necessary to make such demand.

4. Should you fail to effect any repayment as requred and agreed, additional interest will be charged at a rate of 1.5% per month over and above the rate stated above. The borrower hereby acknowledges and that the additional interest represents a reasonable pre-estimate of the loss to be suffered by East Africa Futures Company Ltd. in funding the default of the borrower.

5. You now declare that the information and warranty you have provided to us as the basis of your facility are totally correct and complete.

6. The borrower expressly consents and allows East Africa Futures Company Ltd. to forward personal data and full credit information to the licensed credit reference bureaus in accordance with the banking (credit reference bureaus) regulations, 2008.

7. In connection with this application and/or maintaining a credit facility with East Africa Futures Company Limited, we may carry out credit checks with a credit reference agency. In the event of the account going into default, your name and transaction details will be recorded with the credit reference agency. This information may be used by other institutions in assessing application for credit by you, associated companies and supplementary account holders and for occassional debt tracing and fraud prevention purposes.
