GOLF CART RENTAL AGREEMENT, WAIVER & CONDITIONS OF USE
IMPORTANT — READ CAREFULLY
This Agreement contains a waiver of liability, assumption of risk, and indemnity provisions. By signing below, you acknowledge that you are giving up certain legal rights, including the right to bring a claim against the Owner.
1. ASSUMPTION OF RISK
I acknowledge that the use and operation of a golf cart on an equestrian facility involves inherent risks, dangers, and hazards, including but not limited to:
Collision with pedestrians, riders, horses, livestock, or property
Unpredictable behaviour of horses and animals
Uneven terrain, slopes, mud, gravel, and weather conditions
Mechanical failure or misuse of the golf cart
I freely accept and fully assume all such risks, whether known or unknown, and accept full responsibility for any injury, death, loss, or damage arising from the use of the golf cart.
2. WAIVER & RELEASE OF LIABILITY
In consideration of being permitted to rent and use a golf cart, I, on behalf of myself and my heirs, executors, administrators, and assigns:
Release, waive, and discharge RMSJ, its owners, directors, officers, employees, agents, and representatives (the “Releasees”)
From any and all claims, demands, damages, actions, or causes of action
Including those arising from negligence
For any injury, death, property damage, or loss arising out of or related to the use, operation, or possession of the golf cart.
3. INDEMNITY & THIRD-PARTY LIABILITY
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:
My use or operation of the golf cart
The use or operation of the golf cart by any person I permit to operate or occupy it
Any injury, death, or property damage suffered by third parties
I acknowledge that I am fully responsible for any persons using or occupying the golf cart during the rental period.
4. REGULATIONS & CONDITIONS OF USE
These Regulations form part of this Agreement and must be complied with at all times.
Driver Eligibility
All drivers must be at least 16 years of age and hold a valid driver’s licence
The renter is responsible for verifying all drivers meet these requirements
Use Restrictions
Golf carts must remain on RMSJ property at all times
Carts are strictly prohibited from leaving the premises.
Safe Operation
The driver agrees to operate the golf cart in a safe and responsible manner at all times, including:
Maintaining awareness of pedestrians, riders, and animals
Operating at safe speeds appropriate for terrain and conditions
Not operating under the influence of alcohol or drugs
Complying with all posted signage and facility rules
Responsibility for Use
The renter is fully responsible for the golf cart and all individuals who operate or occupy it
The renter assumes all risk arising from its use
Charging & Care
The renter agrees to return the golf cart daily and ensure it is properly plugged into the designated charging station
Damage, Loss & Repairs
The renter accepts full financial responsibility for:
Any damage to the golf cart beyond normal wear and tear
Any loss of equipment, including lost or unreturned keys ($10 per key)
Any repair or replacement costs resulting from accident, misuse, or negligence
Where repairs are required:
A replacement cart will be provided if available; or
A prorated credit may be issued if no replacement is available
Cleanliness
The renter agrees to remove all garbage and personal belongings prior to returning the golf cart
5. INSURANCE
I understand that RMSJ may not provide insurance coverage for my use of the golf cart and that I am responsible for any applicable personal liability coverage.
6. GENERAL PROVISIONS
This Agreement shall be governed by the laws of the Province of Alberta
If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect
7. ACKNOWLEDGMENT
I confirm that:
I have read and understood this Agreement
I am aware this document affects my legal rights
I am signing this Agreement voluntarily
