AMERICAN RIVER CLASSIC ENDURANCE RIDE - 50 Miles

Liability release

I, Full Name *, inconsideration of the acceptance of this entry, hereby acknowledge that I have voluntarily applied to participate in the American River Classic. I am aware that participating in this event involves possible risk of injury or death to me, my person, my animal and/or property, and involves being in remote areas for extended periods of time, far from communications, transportation, and/or medical facilities, that these areas may have natural and man-made hazards which ride management cannot anticipate, identify, modify or eliminate, and that accidents can happen to anyone at anytime including to myself or my equine.

I understand that I alone am responsible for the health and safety of myself and my equine, including providing and using adequate equine containment/restraint before and after the ride. I also understand and agree that if I am borrowing, leasing, or in any other manner riding an equine that does not legally belong to me that the owner of the equine is aware of and approves of me and the equine entering in and completing this ride. I acknowledge and agree that should myself or the equine require medical or veterinary care that such care is my responsibility alone, or the responsibility of myself and the legal owner of the equine according to our agreement, and that the American River Classic and any and all of its managers, volunteers, or other individuals assisting with the ride have no responsibility.

THEREFORE, I VOLUNTARILY ACCEPT ALL RISK OF PERSONAL INJURY (INCLUDING DEATH), AND PROPERTY DAMAGE, ARISING FROM MY ATTENDANCE AND PARTICIPATION IN THIS EVENT.

As lawful consideration for being permitted to participate in these events, I hereby acknowledge and agree that I, my heirs, personal representatives, assigns and/or spouse, waive, release and give up any cause of action arising from my participation in this event. In addition, I acknowledge and agree that I, my heirs, personal representatives, assigns, and or/or spouse will not make any claim against or sue, and will indemnify the American River Classic, the Auburn Area Recreational District or their respective employees, officers, directors, members, agents, participating landowners and/or affiliated entities for any injury or damage arising from negligence or other acts, however caused of the American River Classic, Auburn Area Recreational District or their respective employees, officers, directors, members, agents, affiliated entities, contractors, guests or invitees.

In addition, I hereby release and discharge the American River Classic, the Auburn Area Recreational District and their respective officers, directors, members, employees, agents, contractors, participating landowners and/or affiliated entities (hereinafter “Releasees”) from all actions, claims or demands that I, my heirs, personal representatives, assigns or spouse, now have, or may have hereafter have, for injuries or property damage resulting or arising from my participation in the American River Classic. I agree that this Release includes injury or damage caused in whole or in part by negligence, active or passive, of the American River Classic, the Auburn Area Recreational District or “Releasees.”

I also expressly waive any rights I may have under California Civil code 1542 which states, “A General release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing that release, which if known by him must have materially affected his settlement with the debtor.”

I acknowledge that equine riding is a sport which carries inherent risks of injury, death and damage to me and the equine. I knowingly assume all risks of participating in equine related-activities including but not limited to injury, death or property damage from: mounting, dismounting, riding, walking, grooming, feeding, use of facilities or trail, falling off an equine, riding without a helmet or otherwise relating to horseback, mule or pony riding or otherwise use and control of, or lack thereof, of the equine, or interactions with other equines. I acknowledge and agree that the American River classic is not responsible for the conduct of other riders, equines, or any other individual or animal on or near the trail, whether or not that other individual or animal entered in this ride. I also understand and agree that it is my responsibility to ride within my abilities and capabilities and that of my equine, and to be alert and aware of the conduct of others on or near the trail, to take steps to appropriately handle myself and my equine and to take steps to avoid situations which appear to contain a higher risk of danger to myself, my equine, others.

I have read this release and waiver of liability and indemnity agreement carefully and completely, and fully understands its contents. I am aware that this is a release of liability and a contract between the American River Classic and its Ride Management and I, and I sign it of my own free will. I further agree that no oral representation, statement or inducements apart from the foregoing written agreement have been made, and that I rely on none.

By signing this release I also agree to all of the Auburn State Recreation Area, AERC and American River Classic Rules. Any Violation of these rules can result in disqualification and future participation in American River Classic and result in forfeiting ride entry.

By Signing this Liability Release, you also agree to all rules, including AERC and State Parks, and the terms of what the ride entry states. Violating any rules whether it be; State Park rules, A.E.R.C. Rules or Ride rules, can either disqualify rider at any point during or prior to start of the ride (will forfeit entry fee) and/or be asked not to return in future dates of ARC. You also understand that this Liability Release is only covered when camp opens the day prior to the ride (Friday, 12:00, pre-vet), to when all ride staff, ride management and veterinarians have left the day of the ride (Saturday, 20:00hrs.) after the ride is concluded.

I am aware that participation in this event involves risk of injury or death to the minor and/or their equine. I agree to maintain adequate insurance coverage the child. I acknowledge that all minors under the age of 18 as of the date of the ride must wear an approved (AHSA, PCA, ANSIZ90.4, or SNELL) helmet, and Jr. Riders must be sponsored, according to AERC rules, by an adult 18 years or older throughout the ride due to the hazardous nature of the trail and the event. I understand that there will be no exceptions to these rules.
