GENERAL INDEMNITY AND WAIVER
In consideration for being permitted to enter, access or remain on the premises and surrounding property (“the premises”) for any purpose whatsoever, including but not limited to participation in activities, observation of activities, or use of any facilities, I hereby, on behalf of myself, my heirs, successors and assigns, release and forever discharge the owners of the premises, landowners, operators, managers, employees, agents, contractors and representatives (“the Releasees”) from any liability for any demand, claim, loss or damage arising from any cause whatsoever, including but not limited to injury and/or damage to person and/or property, including death, whether caused by negligence, gross negligence, recklessness or otherwise, while I am on or at the premises.
I hereby waive any claim which may arise now or in the future against the Releasees in relation to the aforesaid.
I further indemnify and agree to hold harmless the Releasees against any liability, loss, damage or costs which the Releasees may incur arising from my presence on or use of the premises for any purpose whatsoever, whether caused by the Releasees or otherwise.
Where applicable, I sign this document in my capacity as the legal guardian of the minor(s) accompanying me, and I agree that this release, waiver and indemnity shall apply equally to such minor(s).
I expressly acknowledge and agree that certain activities conducted on the premises may be dangerous and may involve the risk of serious injury, death and/or damage to property. I further agree that this release, waiver and indemnity is intended to be as broad and inclusive as permitted under the laws of the Republic of South Africa, and that should any provision be held invalid or unenforceable, the remaining provisions shall continue to be of full force and effect.
I furthermore agree to be held financially responsible for any damage caused by myself or any person under my supervision, including any act of destruction, misuse or vandalism to equipment, facilities or infrastructure on the premises, beyond normal wear and tear, whether accidental or intentional.
