INDEMNITY / DISCLAIMER

I, the undersigned, confirm irrevocably and in rem suam as follows:

1. I am participating in the event and related activities (including but not limited to handling of horses and/or livestock, riding, and general farm work) offered by Khomas Quarter Horse Stud at Farm Wasserfallei, entirely at my own risk. I acknowledge that working with livestock and horses carries inherent dangers, including but not limited to being kicked, thrown, bitten, trampled, or injured by unpredictable animal behaviour, farm equipment, or terrain.

2. I shall not hold Khomas Quarter Horse Stud, Farm Wasserfallei, its owners, organisers, staff, and family members liable for, or have any claim against them, in the event that I (or my horse, if applicable) die, am injured, or suffer any loss, financial, physical or property damage, whether direct or consequential, arising or caused in any manner whatsoever and howsoever occurring at or in connection with this event, whether or not due to negligence or otherwise actionable at law.

3. I hereby indemnify and hold harmless Khomas Quarter Horse Stud, Farm Wasserfallei, its owners, organisers and staff against any claim by any third party for any injury, death, loss or damage of any nature arising from anything done or omitted to be done in connection with this event, whether negligently or otherwise.

4. I authorise the organisers to arrange or consent to emergency medical treatment on my behalf (or on behalf of my child, if applicable) should I be unable to do so myself, and I accept responsibility for any associated costs.

5. I consent to any vehicles, trailers, tack, or other property I bring onto the farm being left entirely at my own risk, and release the organisers from liability for any loss or damage to such property.

6. Khomas Quarter Horse Stud reserves the right to use any photographic or video material taken at the event for advertising purposes or on its website and social media pages.

7. I have read and fully understand the terms of this indemnity/disclaimer, which I accept as valid and binding. Should any uncertainty as to its effect or consequences arise, I alone am responsible for clarifying the legal implications before signing, and I confirm I have done so.

8. I, the parent/guardian (applicable if the participant is under the age of 18), hereby irrevocably indemnify Khomas Quarter Horse Stud in the event of any claim against them by or on behalf of my child.

9. This indemnity/disclaimer shall in all respects be governed and interpreted in accordance with the laws of the Republic of Namibia, and the parties consent to the jurisdiction of the Magistrate's Court of Namibia for any matter arising out of or relating to this document.
