PARTICIPATION WAIVER, RELEASE OF LIABILITY & NIL/MEDIA CONSENT
ASSUMPTION OF RISK
I understand that participation in basketball, including tryouts, practices, games, tournaments, training, conditioning, camps, clinics, and related activities, involves inherent risks of injury. These risks include, but are not limited to, falls, collisions, contact with players or equipment, sprains, fractures, concussions, illness, cardiac events, permanent disability, paralysis, and death.
I voluntarily assume the inherent risks associated with my or my minor child's participation.
RELEASE OF LIABILITY
To the fullest extent permitted by law, I release and hold harmless Semaj Inge Enterprises LLC, Semaj Inge individually, Everyday Hustle, Everyday Hustle Her, Everyday Hustle Florida, and their coaches, employees, volunteers, trainers, contractors, representatives, affiliates, sponsors, facilities, successors, and agents from claims or liabilities arising from the inherent risks of participation, including bodily injury, illness, property damage, permanent disability, or death.
This release does not waive any claim or legal right that cannot lawfully be waived.
MEDICAL AUTHORIZATION
I certify that the participant is physically capable of participating. If a medical emergency occurs and I cannot immediately be reached, I authorize Everyday Hustle representatives to obtain reasonably necessary emergency medical treatment or transportation. I understand that I am responsible for resulting medical expenses, subject to applicable insurance coverage or other legal responsibility.
NIL, PHOTO & MEDIA CONSENT
I authorize Everyday Hustle and Semaj Inge Enterprises LLC to photograph, film, record, and use the participant's name, image, likeness, voice, photographs, video, highlights, statistics, jersey number, and athletic accomplishments for Everyday Hustle promotional, informational, recruiting, advertising, website, social media, and marketing purposes.
I understand that this permission does not transfer ownership of the participant's underlying NIL rights. Unless a separate written agreement provides otherwise, authorized use under this consent does not entitle the participant to royalties or other compensation.
PERSONAL PROPERTY & TRANSPORTATION
Everyday Hustle is not responsible for lost, stolen, or damaged personal property except where required by law. Unless transportation is expressly provided by Everyday Hustle, transportation to and from activities remains the responsibility of the participant and parent/legal guardian.
FLORIDA MINOR PARTICIPANTS
NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND EVERYDAY HUSTLE HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
ACKNOWLEDGMENT
By signing or electronically accepting this agreement, I confirm that I have read and understand it, voluntarily accept the risks described above, agree to the release of liability and NIL/media consent, and, if signing for a minor, certify that I am the participant's parent or legal guardian and have authority to provide these consents to the extent permitted by law.
