    TOWING & ROADSIDE SERVICE AGREEMENT
  • This Service Agreement (“Agreement”) is entered into between ACES Roadside & Recovery (“Company”) and the customer requesting services (“Customer”).

    By requesting service, Customer agrees to the following terms:

    1. SERVICES PROVIDED
    Company may provide the following services:

    Towing & Vehicle Recovery
    Lockout Assistance
    Fuel Delivery
    Battery Jump Start
    Other Roadside Assistance Services
    Services are provided based on availability and site conditions.

     

    2. PAYMENT TERMS
    Payment is due immediately upon completion of service unless otherwise agreed in writing.
    Accepted payment methods: Cash, Credit/Debit Card, or approved digital payment.
    A service fee may apply for cancellations after dispatch.
    Storage fees may apply for vehicles left in Company custody.
    Failure to pay may result in additional fees and/or legal action.

     

    3. CUSTOMER RESPONSIBILITIES
    Customer agrees to:

    Provide accurate vehicle location and information.
    Ensure the vehicle is legally owned or authorized for service.
    Remove all valuables prior to towing.
    Disclose any known mechanical issues, damage, or hazards.
    Company is not responsible for pre-existing damage.

     

    4. LIMITATION OF LIABILITY
    Company is not liable for damage caused by pre-existing mechanical failures.
    Company is not responsible for items left inside the vehicle.
    Company is not responsible for delays due to traffic, weather, unsafe conditions, or circumstances beyond control.
    Jump starts and roadside services are performed at Customer’s risk if the vehicle has underlying mechanical or electrical issues.
    Liability, if any, shall not exceed the total amount paid for the service provided.

     

    5. VEHICLE CONDITION
    Customer acknowledges:

    Vehicle may have existing damage prior to service.
    Certain services may require repositioning or recovery methods that involve normal towing risk.
    Company will exercise reasonable care in performing services.

     

    6. STORAGE & ABANDONED VEHICLES
    Vehicles left in Company custody are subject to daily storage fees.
    Abandoned vehicles may be processed in accordance with state law.

     

    7. INDEMNIFICATION
    Customer agrees to hold harmless and indemnify ACES Roadside & Recovery from claims, damages, or liabilities arising from:

    False ownership claims
    Mechanical failure of vehicle
    Unsafe roadside conditions

     

    8. AUTHORIZATION

    By requesting service (verbally, electronically, or by dispatch confirmation), Customer authorizes ACES Roadside & Recovery to perform the requested services and agrees to these terms.
