• Amicus Brief Template for Immigrant Youth Habeas Petitions

    For use by advocates in habeas proceedings documenting the harms of immigration detention on youth. This template is intended for educational and informational purposes only, and is not intended as legal advice.
  • In fall 2025, a New York City teen from Ecuador was detained by Immigration and Customs Enforcement (ICE) and transfered to a Bronx detention facility under the custody of the Office of Refugee Resettlement (ORR) within the U.S. Department of Health and Human Services.

    Children’s Defense Fund, Children’s Rights, EdTrust–New York, the Kairos Center for Religion, Rights, and Social Justice, and the Young Center for Immigrant Children’s Rights, filed an amicus brief in federal court supporting the teen's habeas petition. The brief was quoted from the bench by the federal judge in making the decision to release the teen.

    Following this success, the five amici and attorneys at Emery Celli Brinckerhoff Abady Ward & Maazel LLP who represented them created a template based on the brief. We hope the brief can be adapted to the facts of other cases of young people detained in immigration facilities in various jurisdictions.
