1. Acknowledgment of Risks

The Owner acknowledges and understands that there are inherent risks associated with pet care services provided by the Service Provider, including but not limited to injury, illness, accident, escape, or death.

2. Waiver and Release of Liability

In consideration of services provided, the Owner hereby waives, releases, and discharges the Service Provider, its employees, agents, contractors, and representatives from any and all claims, liabilities, damages, expenses, or causes of action arising directly or indirectly from the services provided, except in cases of gross negligence or willful misconduct.

3. Indemnification

The Owner agrees to indemnify, defend, and hold harmless the Service Provider from and against any and all claims, liabilities, damages, expenses, or causes of action, including reasonable attorney fees, arising out of or in connection with the services provided to the Owner’s pet(s).

4. Emergency Veterinary Care Authorization

In the event of a medical emergency, the Service Provider will make reasonable efforts to contact the Owner. If the Owner cannot be reached, the Service Provider is authorized to seek veterinary care at the Owner’s expense.

The Owner agrees to:

•Cover all veterinary expenses incurred

•Pay a $50 emergency handling fee

If emergency care results in missed scheduled services with other clients, the Owner agrees to compensate the Service Provider for any lost income resulting from those missed scheduled services.

5. Assumption of Responsibility

The Owner assumes full responsibility for any harm or damage caused by their pet(s) to any person, other animals, or property while in the care of the Service Provider.

6. Cancellation Policy

Dog Sitting Services:

For all bookings of 3 nights or longer, a $100 non-refundable deposit is required at the time of booking to secure dates. This deposit will be applied toward the total cost of the stay.

The remaining balance is due upon service completion.

The $100 deposit is non-refundable. If the client needs to reschedule, the deposit may be applied to a future dog sitting service, provided the new booking is scheduled within 60 days of the original start date. After this period, the deposit will be forfeited.

If the booking is cancelled entirely and not rescheduled, the deposit will not be refunded.

Dog Walking Services:

The Owner agrees to pay 50% of the scheduled service cost for cancellations made within 48 hours of the scheduled service.

Cancellations made more than 48 hours in advance will not incur a fee.

Exceptions:

Cancellation fees will not apply in cases of:

•Inclement weather

•Service Provider cancellation

7. Payment Terms

Payment is due in full upon completion of services unless otherwise agreed in writing.

If payment is not received within 48 hours of service completion, the Service Provider reserves the right to pursue collection of unpaid balances through appropriate legal means.

The Owner agrees to be responsible for any costs associated with collecting unpaid balances, including reasonable legal fees where permitted by law.

8. Home Access & Security

The Owner agrees to provide accurate and functional access to the home (keys, codes, instructions, etc.) at the time services begin.

If the Service Provider is unable to access the home due to incorrect or non-working access information, the Owner may still be responsible for the full cost of the scheduled service.

The Service Provider is not responsible for any security system issues or false alarms arising from provided instructions.

9. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. Any legal action or proceeding arising out of or related to this Agreement shall be brought in the courts located in New Hanover County, North Carolina.

10. Insurance Coverage

This agreement does not affect any rights the Owner may have under any liability insurance carried by the Service Provider.

11. Modifications

This Agreement may only be modified or amended in writing and signed by both parties.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Acceptance and Acknowledgment

By signing below, the Owner acknowledges that they have read, understood, and voluntarily agree to the terms and conditions outlined in this Agreement. The Owner acknowledges that they have had the opportunity to seek independent legal advice prior to signing.
