TERMS AND CONDITIONS OF PARTICIPATION – READ CAREFULLY BEFORE SIGNING
As used below, “All City Music” shall mean Twin Cities Community Arts, LLC, DBA All City Music, and the officers, directors, employees, agents, successors, and assigns of each of the foregoing. In consideration of my minor child or ward's participation, in music, dance, percussion, or marching activities conducted by All City Music on or about July 13th, 2026 through July 24th, 2025 pursuant to the All City Music Events (the “Event”), wherever the Event and/or activities may occur, you hereby attest that after reading this Form completely and carefully, including the notice above your signature, you acknowledge that participation in the Event by your minor child or ward is entirely voluntary, and that you understand and agree as follows:
In consideration of allowing my child/ children to participate in the activities provided by All City Music, I, the undersigned parent/guardian, hereby acknowledge and agree to the following terms and conditions:
1. Assumption of Risk: I understand and acknowledge that participation in the activities provided by All City Music may involve certain inherent risks, including but not limited to bodily injury, property damage, illness, or death. I voluntarily assume all such risks associated with my child's participation.
2. Release of Claims: I hereby release, discharge, and hold harmless All City Music, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child, or to any property belonging to my child, whether caused by the negligence of All City Music or otherwise.
3. Indemnification: I agree to indemnify, defend, and hold harmless Twin Cities Community Arts dba All City Music, its officers, directors, employees, agents, and representatives from and against any and all losses, liabilities, damages, expenses, and costs, including but not limited to attorney's fees, arising out of or resulting from my child's participation in the activities provided by Twin Cities Community Arts dba All City Music.
4. Representation of Fitness: I represent that my child is physically and mentally capable of participating in the activities provided by Twin Cities Community Arts dba All City Music. I acknowledge that I have disclosed any medical conditions, disabilities, or other limitations that may affect my child's participation.
5. Photography and Videography Release: I consent to the use of my child's image, likeness, and voice in any photographs, videos, or other recordings taken during my child's participation in the activities provided by Twin Cities Community Arts dba All City Music for promotional or other purposes without compensation or notification.
6. Binding Effect: This waiver and release shall be binding upon me, my child, our heirs, executors, administrators, and assigns.
7. Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of Minnesota/United States of America, without regard to its conflict of law principles.
By signing below, I acknowledge that I have read and understand this waiver and release of liability and consent to my child's participation in the activities provided by Twin Cities Community Arts dba All City Music, subject to the terms and conditions outlined herein.
