1. Grant of Permission and License By submitting content (“Submission”), you grant Basin Harbor a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, publish, display, distribute, edit, and share the Submission for marketing, promotional, editorial, and archival purposes across all media formats now known or later developed. This includes, but is not limited to, use on websites, social media, digital and print marketing materials, advertising, publications, exhibitions, and historical archives.
2. Ownership and Rights Confirmation You represent and warrant that you either: are the creator and owner of the submitted content, or have obtained all necessary permissions and rights from the photographer or copyright holder to submit the content and grant the permissions described above. You further confirm that submission of the content does not infringe upon the rights of any third party.
3. Consent of Individuals Appearing in Images You confirm that any identifiable individuals appearing in the Submission have granted permission for their likeness to be used by Basin Harbor for the purposes outlined in these terms.
4. Images Featuring Minors If the Submission includes an individual under the age of 18, you represent and warrant that you are the minor’s parent or legal guardian, or that you have obtained consent from the minor’s parent or legal guardian for submission and use of the image as described herein. Basin Harbor reserves the right to decline or remove any content featuring minors at its sole discretion.
5. Editing and Use Discretion Basin Harbor reserves the right to edit, crop, enhance, adapt, or decline any Submission for any reason, including alignment with brand standards, quality, or appropriateness.
6. No Compensation Submission of content is voluntary. You understand and agree that no compensation, payment, or royalties will be provided for the use of your Submission.
7. Attribution Basin Harbor may credit contributors by name when reasonably possible unless you request otherwise at the time of submission.
8. Archival and Future Use Submissions may be preserved as part of Basin Harbor’s historical archive and may be used in future storytelling initiatives, anniversary celebrations, or legacy projects that celebrate the resort’s heritage and community.
9. Digital and Technical Use You acknowledge that submitted content may be digitally enhanced, reformatted, or adapted for various media formats and platforms.
10. Privacy Information collected in connection with your Submission will be used solely for purposes related to the Basin Harbor archive and communications regarding your submission and will not be sold to third parties.
