In consideration of being allowed to participate in weightlifting activities, including but not limited to weightlifting assessments, training sessions, classes, weightlifting competitions, travel or any other activities conducted by Sandusky Weightlifting LLC (SW), I, the undersigned, acknowledge, understand, and agree to the following terms and conditions:
1. Assumption of Risk
I understand that weightlifting and other physical activities involve inherent risks, including but not limited to injuries, strains, sprains, fractures, and other physical harm, including death. I voluntarily assume all risks associated with my participation in these activities, including the weightlifting assessment and any subsequent training, programs, and competitions. I acknowledge that I am participating in these activities at my own risk.
2. Physical Condition
I confirm that I am in good physical health and have no medical conditions that would prevent me from safely participating in weightlifting or any related assessments or activities. It is my duty and responsibility to consult a physician before beginning any physical activity program if I have any doubts about my fitness level or if I have any medical conditions that may affect my ability to participate in weightlifting activities, I shall not participate in a weightlifting assessment, training sessions, or compete in meets or competitions. I understand this is an ongoing duty and responsibility and if my health or fitness changes at any time, I will cease activities.
3. Weightlifting Assessment
I understand that the weightlifting assessment is designed to evaluate my strength, form, and overall readiness for weightlifting activities. I acknowledge that the assessment may involve various physical movements and exercises that carry potential risks. I agree to follow all instructions provided by SW staff during the assessment to reduce the likelihood of injury. If at any point during the assessment I feel unwell or experience discomfort, I will immediately stop all activities and notify the SW staff. I am solely responsible for my own health and safety and release SW of any liability therefrom as outlined below.
4. Release of Liability
I hereby release, waive, discharge, and covenant not to sue Sandusky Weightlifting LLC, its owners, operators, instructors, employees, agents, and volunteers (collectively referred to as the "Released Parties") from any and all liability for any injury, damage, including death or loss sustained by me while participating in weightlifting activities, including during the weightlifting assessment, training sessions, classes, competitions, or any other activities and travel regardless of whether such injury, damage, death, or loss is caused by the negligence of the Released Parties or otherwise.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, or lawsuits arising out of or in connection with my participation in weightlifting activities, training sessions, competition, travel, or any other activities including the weightlifting assessment, and any injury or damage I may cause to others or to myself.
6. Emergency Medical Treatment
In the event that I am injured or require medical attention during my participation in weightlifting activities, I authorize the Facility staff to seek emergency medical treatment for me if necessary. I agree to assume all responsibility for any medical costs incurred as a result of any injury or emergency treatment.
7. Compliance with SW Rules
I agree to abide by all rules, policies, and guidelines established by SW, including those related to safety, conduct, and proper use of equipment. I acknowledge that failure to comply with these rules may result in termination of my access to the SW and its services as well as injuries to myself or others. I accept full responsibility for any injuries or damage I may cause as a result of my failure to comply and follow SW rules and waive any claims against SW as a result thereof.
8. Severability
If any provision of this Waiver and Release of Liability is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9. Governing Law
This Release is governed by the laws of Ohio and any disputes arising hereunder will be resolved in accordance with those laws. Jurisdiction and venue is specifically designated in Erie County Ohio.
10. Entire Agreement
This document represents the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements regarding the liability waiver and release of claims.
By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Waiver and Release of Liability. I am aware that by signing this document, I am waiving certain legal rights, including the right to sue the Released Parties for any injury, damage, or loss I may suffer.
