⛔️Food Liability Waiver and Release of Claims & refund policy ⛔️ ————————————————————❌❌❌❌⚠️⚠️⚠️⚠️By paying for, accepting, or signing for services provided by Boards by Nakayla (hereafter referred to as "the Company"), the client (hereafter referred to as "the Client") agrees to the following terms and conditions (1-3): ❌❌❌❌❌⚠️⚠️⚠️⚠️⚠️1. Consumption of Food and PerishablesThe Client understands that the Company prepares artisanal charcuterie boards and platters that contain perishable food items (including but not limited to meats, cheeses, fruits, vegetables, and nuts). The Client assumes full responsibility for ensuring that all food items are kept refrigerated at or below 40°F (4°C) until consumption and are not left at room temperature for more than two (2) hours. The Company is not responsible for food spoilage or illness due to improper storage, handling, or delayed consumption after delivery or pickup. ❌❌❌❌❌⚠️⚠️⚠️⚠️⚠️2. Food Allergies and Dietary RestrictionsThe Client acknowledges that the Company's food products are prepared in a facility that handles common food allergens, including milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, and soybeans. While the Company may attempt to accommodate specific dietary requests, the Company cannot guarantee zero cross-contamination. It is the sole responsibility of the Client to notify their guests or consumers of potential allergen exposure. The Company is not liable for any allergic reactions, adverse health effects, or medical emergencies resulting from the consumption of its products. ❌❌❌❌❌⚠️⚠️⚠️⚠️⚠️⚠️3. Assumption of Risk and Waiver of LiabilityThe Client explicitly acknowledges that the Company operates as an uninsured business.By signing below or fulfilling payment for this order, the Client, on behalf of themselves and their guests, hereby releases, waives, and forever discharges the Company, its owners, and its operators from any and all liability, claims, demands, or causes of action arising out of: Foodborne illnesses or food poisoning. Allergic reactions or adverse health complications. Any other injuries, damages, or illnesses resulting directly or indirectly from the consumption or handling of the Company's products. ————————————-—— ⛔️Perishable Food & Refund Policy ⚠️⚠️⚠️ Freshness & Storage: All boards and boxes are custom-made using fresh, highly perishable ingredients. To ensure food safety and optimal quality, items must be kept continuously refrigerated until consumed and are best enjoyed within 24 hours of delivery or pickup. Boards By Nakayla is not responsible for the quality, presentation, or safety of items stored incorrectly after transfer. ⚠️⚠️⚠️ Refunds & Subjective Taste: Because ingredients are sourced immediately upon order confirmation—particularly for last-minute orders placed within 48 to 72 hours of an event—all sales are final. Refunds, partial credits, or replacements are only issued in the event of a verified quality defect or order fulfillment error.
