Waiver and Release of Liability
I, the undersigned client, hereby agree to participate in online fitness training services provided by Hoopie Hybrid Training LLC, doing business as Hoopie Strength & Conditioning, coached by Cody and Catherine Miller.
I understand and acknowledge the following:
Nature of Training
I understand that Hoopie Strength & Conditioning provides online, community-based hybrid training programs that are not individually supervised in real time. Programming may include strength training, cardiovascular exercise, mobility work, and general nutrition guidance. I acknowledge that the programming is not specifically tailored to my individual medical conditions or physical limitations.
Voluntary Participation
I acknowledge that my participation in this program is voluntary. I understand that I may decline to perform any exercise or discontinue participation at any time.
Health and Medical Responsibility
I affirm that I am in good physical condition and have no known medical conditions that would prevent safe participation in physical exercise. I understand that it is my responsibility to consult with a qualified medical professional prior to beginning this or any exercise program if I have concerns about my health. I acknowledge that the services provided are not medical advice and are not a substitute for professional medical care, diagnosis, or treatment.
Assumption of Risk
I understand that participation in physical exercise involves inherent risks, including but not limited to muscle soreness, strains, sprains, injury, illness, heart attack, or, in rare cases, death. I voluntarily accept and assume full responsibility for all risks associated with my participation.
Environment and Equipment Responsibility
I acknowledge that I am responsible for ensuring that my exercise environment is safe and that any equipment I use is in proper working condition. I understand that coaches are not physically present to supervise or correct movements during my workouts.
Waiver and Release
In consideration of being permitted to participate in the program, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and forever discharge Hoopie Hybrid Training LLC, its owners, coaches, agents, employees, and representatives from any and all claims, demands, damages, liabilities, costs, or expenses arising from or related to my participation, including claims based on negligence.
Indemnification
I agree to indemnify and hold harmless the released parties from any loss, liability, damage, or cost, including reasonable legal fees, arising out of my participation in the program.
Privacy
I understand that personal information collected will be used solely for the purposes of providing coaching services and will not be shared except as required by law.
Acknowledgment and Signature
By signing below, I acknowledge that I have read and fully understand this Waiver and Release of Liability, and I voluntarily agree to its terms. I understand that this agreement is binding and that my electronic signature is legally valid.

All training and nutrition guidance is provided for educational purposes only and is not intended as medical advice. Our services are not designed to diagnose, treat, cure, or prevent any medical condition and should not replace guidance from a qualified healthcare provider. You are solely responsible for determining whether to follow any recommendations provided. If you have any medical concerns or pre-existing conditions, please consult your physician before beginning any new training or nutrition program.
1. Onboarding
Training App Access
Clients may purchase access to the Hoopie Strength & Conditioning training app at any time.
Clients receive an email confirmation immediately after purchase
Full app access is granted within 24 hours
Subscriptions begin upon purchase and auto-renew every four weeks
One-on-One Coaching
All one-on-one coaching begins with a discovery call to ensure the service is the right fit.
If proceeding:
Payment is submitted
An intake form is completed
An onboarding call is scheduled to review the plan and expectations
Individualized programming is delivered within 72 hours of intake completion. Coaching check-ins begin according to the client’s subscription tier.
2. Communication Expectations
General Communication Standards
We aim to respond to client communication within 24 hours during normal business days.
Please note:
Hoopie Strength & Conditioning coaches do not guarantee responses on Sundays.
Non-urgent messages received on Sundays will be addressed on the next business day
Urgent messages must be clearly labeled “URGENT” to receive same-day attention
App-Only Clients
All communication takes place in the Hoopie Community group chat
Direct messages will be redirected to the community and will not be individually answered

Clients receive weekly automated reflective check-ins for self-assessment
No individualized coaching or personal check-ins are included
Clients seeking more personalized guidance may upgrade to one-on-one coaching by contacting hello@hoopiestrength.com.
Hoopie Pro Coaching
Clients may communicate via WhatsApp, Everfit, or email
24-hour response window during business days
Monthly Check-Ins
Clients complete a check-in form on their assigned date
Coaches respond via LOOM within 24 hours
Late submissions may result in delayed responses
Monthly Video Calls
One Google Meet call per month (~20 minutes)
Call schedule is established during intake
Rescheduling requires 72 hours notice
Hoopie Elite Coaching
Unlimited messaging via WhatsApp, Everfit, or email
24-hour response window during business days
Weekly Check-Ins
Weekly form submission on assigned date
Response via LOOM within 24 hours
Late submissions may receive delayed feedback
Monthly Video Calls
One Google Meet call per month (~20 minutes)
Same scheduling and rescheduling expectations as Pro coaching
3. Subscription & Billing
All Hoopie Strength & Conditioning coaching services require a minimum three-month commitment
Subscriptions auto-renew every four weeks
One pause (up to 60 days) is allowed after the initial three-month commitment
Additional pauses are granted at coach discretion
Pause requests must be submitted at least 72 hours before the billing date
To cancel a subscription:
Clients must email their coach at least 72 hours prior to the billing date
A call will be scheduled to discuss termination
If payment processes before communication occurs, refunds are not guaranteed and transaction fees may apply
Clients are responsible for keeping payment information up to date. Coaches will provide payment update links if needed.
4. Refund Policy
Training App
No refunds once app access is granted
Cancellation is permitted after the three-month minimum commitment with proper notice
Hoopie Pro & Elite Coaching
Three-month minimum commitment required
No refunds once payment is processed
Cancellation requires 72-hour notice prior to billing date
Payments continue until cancellation is formally communicated
If pricing changes, clients will receive at least 30 days notice.
5. Privacy & Data Use
All client information is treated as confidential. Reasonable measures are taken to protect against unauthorized access or data loss.
Client testimonials, written feedback, voice recordings, or images may be used for promotional purposes. Full names and identifiable images will never be shared without explicit consent.
6. Changes to Terms
Hoopie Strength & Conditioning reserves the right to modify these Terms and Conditions. Clients will be notified at least seven days prior to changes taking effect.
7. Vacations, Holidays, and Availability
Coaches may take one week of vacation per quarter
During this time, only messages labeled “URGENT” will receive responses within 24 hours
Training plans will be delivered in advance
Video reviews may be paused unless during competition prep
Coaches are entitled to two full weeks of vacation per year with no communication availability. Major holidays (Easter, July 4th, Thanksgiving, Christmas Eve/Day, New Year’s Eve/Day) are observed, and communication will resume the next business day.
