• RIGHT OF ENTRY AND RELEASEFOR LEAD SERVICE LINE REPLACEMENT

  • The Town of Westerly ("Town") and Community Infrastructure Partners (CIP) are initiating the EquiFlow Lead Free Program (the "Program") to replace lead service lines throughout the Town. The Town requests that you, as the owner ("Owner") of the property, an "Authorized Person," including but not limited to a property manager or any individual with the legal authority to act on behalf of the Owner regarding property-related decisions; or as a lessee, renter, or another lawful occupant of the property ("Occupant"), sign, complete, and return this document ("Right of Entry") to grant the EquiFlow Lead Free Representatives ("Program Representatives") a right of entry onto your property, which has the following street address (the "Property"), so the Town may complete a "Lead Service Line Replacement."
  • REASON FOR THE TOWN'S REQUEST FOR A RIGHT OF ENTRY:

  • LEAD SERVICE LINE REPLACEMENT: The Town's records indicate that the pipe from the Town's water main to Your Property may be made of lead or galvanized iron/steel. A water service line made of lead, also known as a lead service line, can increase your risk of exposure to lead through drinking water and should be replaced if possible. The Town is planning to replace the lead service line that connects your property to the Town's water main. This replacement might involve replacing part or the entire water service line and is called a "Lead Service Line Replacement."

  • The Program Representatives will need access to the Property to perforin work associated with the Lead Service Line Replacement ("Work"). The Program Representatives will show you their respective identification prior to entering the Property.
  • This Work involves shutting off the water service for an estimated four (4) hours, replacing the existing lead or galvanized iron/steel water service, and installing a new copper service from the water main in the street to the Property and into the home with connection to the water meter. Before beginning work, the Program Representatives will notify you when they will be on the Property to perform the work. It is your responsibility to provide reasonable access and a working area at the service line and water meter location, as requested by the Program Representatives. The Program Representatives may continue to enter onto the Property until construction is completed and you and the Town accept the work.
  • RIGHT-OF-ENTRY:

  • By signing and returning this Right of Entry, you grant the Town and the Program Representatives the right to enter the Property between April 1, 2026 and November 1, 2028, between the hours of 7:00 a.m. and 6:00 p.m. The right to enter the Property is for the following purposes:
    • Survey and take photographs and videos of the interior area of the home where the water service line is located and exterior of the Property where work is to be performed; and
    • Replacement of your lead or galvanized iron/steel Service Line.
  • The Program Representatives will suitably identify themselves prior to entering the Property.
  • PLEASE NOTE: You and the Town agree and understand that Lead Service Line Replacement cannot begin until the Town has on file your signed Right of Entry.
  • In consideration of the foregoing, you affirm that you have a property interest in the Property, either by lease or ownership or are otherwise authorized to grant to the Town a Right of Entry to allow the Town and Program Representatives to enter the Property, to take photographs and videos of the interior and exterior of the Property in the area of the water service line before and after installation, to bring workers, material, equipment, and supplies onto Your Property and to perform the Lead Service Line Replacement on the Property.
  • Restoration to preconstruction conditions will not always be possible, and the extent of demolition and restoration will be discussed with you and agreed upon prior to beginning the work. At that time, you may decline to participate in the Lead Service Line Replacement.
  • The Program Representatives will connect the new copper service line to the existing plumbing at the entry point into the Property. The Town is not responsible for any interior plumbing beyond the meter nor is the Town responsible for updating any interior plumbing for compliance with the Rhode Island or Westerly Plumbing Code or other codes once the service line enters the Property. The property owner is responsible for replacing interior plumbing when and where necessary or required by the local regulations. While the Town will replace part or the entire water service line, this work does not change ownership or maintenance obligations from the existing requirements. The property remains fully responsible for the water service line from the curb stop to the water meter inside the home.

  • As part of the lead service line replacement and meter installation process, you, the undersigned, acknowledge and agree to release the Town of Westerly, its employees, and legal affiliates (collectively referred to as the "Town") and the EquiFlow Lead Free Program Representatives from any liability related to potential claims, including injury, property damage, or loss, that may arise in connection with the completion of the lead service line replacement.

  • I read the Right of Entry and Release Agreement and AGREE to allow the Town of Westerly and the EquiFlow Lead Free Program Representatives on my property to replace the lead service line. The authorized person or I will be present during construction
