Waiver Agreement (Please read carefully and agree below) By* This field is required.Bayou Beast Rage Room Waiver & Release of Liability READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS By participating in Bayou Beast Rage Room activities, whether at our facility or via a mobile rage experience, you acknowledge and agree to the following: 1. Entertainment & Purpose Disclaimer Bayou Beast Rage Room is an entertainment and recreational experience only. Participation is voluntary. Staff are not medical, mental health, or healthcare providers. Activities are not intended to diagnose, treat, cure, or prevent any medical or mental health condition, nor are they a substitute for professional care. Participation is self-pay, and medical insurance is not accepted. 2. Assumption of Risk & Injury Acknowledgment Rage Room activities involve physical exertion, loud noise, flying objects, and potential hazards. Participants acknowledge that smash-based activities involve inherent risks including but not limited to: Cuts, bruises, scrapes, or muscle strain Physical injury, slips, falls, or collisions Emotional response or stress Exposure to paints, powders, neon/glow materials, or other substances Allergic reactions or sensitivities Property damage or clothing damage Unforeseen or unknown risks Participants voluntarily assume all such risks, and agree to participate at their own risk. 3. Medical Fitness & Physical Condition Participants affirm that they are physically able to participate and do not have any medical condition that would make participation unsafe, including but not limited to: Heart conditions Pregnancy Injuries or physical limitations Seizures, dizziness, or other health conditions Bayou Beast Rage Room is not responsible for medical events occurring during or after participation. 4. Age Requirements, Parental Supervision & Liability Ages 5–12: Kid Zone only, paint-based activities. No glass, sharp objects, or flying debris. Materials are non-toxic, non-hazardous, water-based, and safe for recreational use. Children must be supervised by a parent, legal guardian, or Bayou Beast staff member at all times. Ages 13–17: May participate in solo or group rage experiences under adult supervision. Ages 18+: Full access to all rage room experiences. Parental Liability: Parents and legal guardians accept full responsibility and liability for minors participating, including any claims, injuries, or damages. Waiver Requirement: All participants under 18 require a signed waiver by a parent or legal guardian. Adults must also sign a waiver before participating. No participant may enter without a completed waiver. 5. Safety, Clothing & Equipment Closed-toe shoes are REQUIRED. Participation will be denied without proper footwear. No exceptions. Protective gear is provided, including helmet, face shield or eye protection, gloves, and coveralls. All protective gear must be worn at all times inside the rage room. Participants must follow all safety rules, instructions, and staff guidance. Failure to comply may result in immediate termination without refund. 6. Intoxication & Substance Use Participants may not participate under the influence of alcohol, drugs, or any impairing substance. Bayou Beast Rage Room reserves the right to refuse service without refund if intoxication is suspected. 7. Property & Damage Liability Participants are financially responsible for any damage caused outside of designated rage areas due to negligence, misuse, or failure to follow instructions. 8. Waiver & Release of Liability You hereby release, waive, and discharge Bayou Beast Rage Room, its owners, employees, contractors, and affiliates from any liability, claims, demands, or actions, including those arising from ordinary negligence. This release does not apply to gross negligence, intentional misconduct, or unlawful acts. 9. Indemnification You agree to indemnify and hold harmless Bayou Beast Rage Room against all claims, damages, losses, or expenses arising from your participation, including claims brought by third parties. 10. Emergency Medical Consent In the event of an emergency, staff are authorized to seek medical treatment for minors if a parent or guardian is unavailable. Participation is voluntary and at your own risk. 11. Mobile Event Liability I acknowledge that participation in a Bayou Beast Rage Room mobile event involves inherent risks including but not limited to: Broken glass and sharp objects Flying debris Slips, trips, and falls Physical exertion Serious bodily injury I voluntarily assume all risks associated with participation. I understand that protective equipment will be provided and must be worn at all times. I must follow all staff instructions. Failure to comply may result in removal from the activity without refund. I release and hold harmless Bayou Beast Rage Room LLC, its owners, employees, contractors, and affiliates from any claims arising out of participation, including injury, death, or property damage, except in cases of gross negligence. I confirm that I am physically able to participate and am not under the influence of drugs or alcohol. Bayou Beast Rage Room is not responsible for conditions of third-party venues, including ground conditions, weather, or environmental hazards during mobile events. HOMEOWNER AGREEMENT – MOBILE EVENT The Client acknowledges Bayou Beast Rage Room will set up a contained smash zone using tarps and protective barriers. The Client is responsible for selecting and approving the event location (driveway, garage, backyard, etc.). The Client confirms the selected area is structurally sound and free of pre-existing hazards. Bayou Beast Rage Room is not responsible for pre-existing damage to surfaces. Minor surface markings or cosmetic debris residue may occur despite containment efforts. All debris will be removed upon completion of the event. The Client agrees to keep non-participants outside of the designated smash zone at all times. FOR MINORS I am the parent/legal guardian of the minor participant. I consent to their participation and agree to indemnify and hold harmless Bayou Beast Rage Room LLC from any claims related to their participation. 12. Media & Communications Consent Bayou Beast Rage Room may capture photos or videos for safety, promotional, or marketing purposes. Participation constitutes consent unless otherwise requested in writing. Refusal of media consent does not affect participation. By providing your contact information, you consent to receive transactional and promotional communications via email and SMS. Promotional messages may be opted out of at any time. 13. Booking, Cancellation & Arrival Booking: Reservations are strongly recommended. Walk-ins may be accepted based on availability. Deposit: A 50% non-refundable deposit is required. Cancellation/Rescheduling: Policies are posted on our website and apply to all bookings. Arrival: Participants should arrive at least 10 minutes early; late arrivals may result in reduced session time. 14. Right to Refuse Service Bayou Beast Rage Room reserves the right to refuse service to anyone at any time for: Safety reasons Violation of rules Intoxication or unsafe behavior Failure to follow staff instructions Conduct that may endanger themselves, staff, or others 15. Governing Law & Severability This agreement is governed by the laws of Texas. Any disputes shall be resolved in the state or federal courts located in Denton County, Texas. If any provision of this waiver is found invalid, the remaining provisions remain enforceable. 16. Electronic Signature By providing an electronic signature, you acknowledge that you have read, understood, and voluntarily agree to all terms, including: Assumption of risk Entertainment-only disclaimer Physical fitness affirmation Injury acknowledgment Compliance with staff instructions Parent liability Mobile event liability Indemnification Waiver & release 17. Privacy and Data Protection Collection and Use: By providing your personal information (including name, contact info, and billing information), you consent to its use by Bayou Beast Rage Room for purposes of booking, communication, membership, event management, and promotional communications. No Sale of Information: Bayou Beast Rage Room will not sell, trade, or rent your personal information to third parties. Data Security: We take reasonable administrative, technical, and physical measures to protect your personal information from unauthorized access, use, or disclosure. Data Breach Notification: In the unlikely event of a data breach affecting your personal information, Bayou Beast Rage Room will notify affected individuals promptly in accordance with applicable Texas and federal law.
