To ensure the safety and enjoyment of all guests, Kencha House requires that a waiver be signed before entering our indoor playground facility. By signing this waiver, you acknowledge and accept the risks associated with play activities and agree to the terms and conditions outlined below. Thank you for your cooperation and understanding.
In consideration of Kencha House at 105 - 222 Finch Ave W, North York, ON M2R 1M6 (the “Facility”), granting access to the below-named child(ren) (each a “Child,” collectively the “Children”) under the supervision of the undersigned parent or guardian, visitor, or supervising adult (the “Participant”), I hereby, on behalf of myself, my Child/Children, and our heirs, executors, administrators, and assigns, agree as follows:
1. Parental Responsibility
I represent and warrant that I am the parent or legal guardian of the below-named Child/Children. I accept full responsibility for their supervision while in the Facility.
2. Assumption of Risk
I acknowledge and understand that indoor play involves inherent risks that may result in property damage, injury, or death. These include, but are not limited to, collisions, falls, or misuse of play equipment. I voluntarily assume all risks, known and unknown, on behalf of myself and my Child/Children.
3. Acceptance of Rules
I have read and agree to the Kencha House Facility Rules, which form part of this Waiver. I agree to ensure that my Child/Children follow these Rules. Failure to comply may result in removal from the Facility without refund.
4. Photo and Media Consent
I give permission for Kencha House to capture photos or videos of my Child/Children while in the Facility, which may be used for promotional or marketing purposes on the company’s website, social media, or printed materials. I understand that no personal information will be disclosed.
5. Release and Indemnity
I release and forever discharge Kencha House, its shareholders, officers, directors, employees, contractors, agents, and representatives (collectively the “Representatives”) from any and all claims, liabilities, or damages arising from use of the Facility, including injury, loss, theft, or death, whether caused by negligence or otherwise. I agree to indemnify and hold harmless Kencha House and its Representatives from any resulting claims, expenses, or costs.
6. Emergency Medical Authorization
In the event of injury or illness, I authorize Kencha House to obtain emergency medical treatment for my Child/Children and release them from liability for any resulting costs, treatment, or outcomes.
7. Health and Fitness
I represent that my Child/Children are in good physical condition and medically fit to participate in play activities.
8. Multi-Use and Duration of Waiver (6-Month Validity)
I agree that this Waiver will remain valid and in full effect for a period of six (6) months from the date of signing. It applies to all future visits by the below-named Child/Children to Kencha House within that time, without the need to complete a new waiver at each visit.
By returning to the Facility during this period, I confirm that:
I have reviewed the Waiver and accept that it remains in effect;
No material changes have occurred in my Child’s health or guardianship status; and
I understand I may revoke this Waiver at any time in writing before its expiration.
9. Refusal of Entry
I understand that if I do not sign this Waiver, I and my Child/Children will not be permitted entry to the Facility.
10. Health and Safety Guidelines
I agree to follow all Kencha House health and safety protocols, including infectious disease policies. The Facility reserves the right to deny entry or remove any guest who fails to comply.
11. Severability
If any provision of this Waiver is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Behaviour and Conduct
I will ensure that my Child/Children behave respectfully and safely. Aggressive behaviour, bullying, or unsafe play may result in removal from the Facility without refund.
13. Acknowledgment of Activity Risks
I acknowledge that activities such as slides, climbing structures, and other interactive play equipment carry inherent risks. I voluntarily assume these risks on behalf of my Child/Children.
14. Digital Signature and Record-Keeping
If signed electronically, I agree that my digital signature is legally binding and consent to Kencha House securely maintaining digital records of this Waiver in compliance with privacy laws.
15. Evacuation Responsibility
In the event of an emergency, I am responsible for safely evacuating my Child/Children and following staff instructions at all times.
Kencha House – Play Cafe Rules
1. All children must be supervised by a responsible adult (16 years or older).
4. All guests must remove shoes.
5. Food and drinks must be consumed in the café or party room.
6. No outside food or beverages are permitted in the play area.
7. Toys must remain in their designated play areas.
8. Kencha House is not responsible for lost or stolen items.
9. Strollers are not permitted in the play area.
