ASSUMPTION OF RISK AND CONTRACT FOR PARTICIPATION
In consideration of the acceptance of my participation in this activity, I hereby freely agree to the following contractual representation and agreements:
All Senior Send Off activities and programs involve a risk that the participant could suffer injury. The programs and activities are carefully monitored and the instructors and coordinators have been advised of the potential safety hazards. However, there is always the possibility that a participant might suffer physical injury. Among these risks are the following: falling from heights, tripping over someone or an object, cuts and/or abrasions from activities, and other risks associated with interaction among participants.
These dangers present the possibility of serious physical injury, mental trauma or death. I fully realize the dangers of participating in an activity of this nature and voluntarily assume all responsibility for risks of any injuries or property damage associated with such participation.
I agree that it is my responsibility to be familiar with the physical and/or mental demands associated with the activity. With this in mind, I have no physical or mental condition that, to my knowledge, would endanger others or myself if I choose to participate in any activity during the Senior Send Off.
I agree to abide by established rules or regulations while participating in the Senior Send Off. I understand and agree that situations may arise during the activities that may be beyond the control of the coordinators, or other participants. I shall indemnify, forever discharge and save harmless all instructors, coordinators, assistants, directors, board members and any other companies or individuals under the contract who may be associated with the Senior Send Off from any and all liability.
I agree, for myself and my successors, that the above representations and agreements are contractually binding and are not mere recitals. I agree that my failure or refusal to sign other such agreements or release shall in no way affect the validity of the agreement nor invoke or cancel any of the terms. Furthermore, in the event that a claim or suit is brought forth in violation of this agreement, I or any of my successors shall be liable for the expenses incurred by the other party or parties in defending against such actions. This agreement may not be modified orally.
I HAVE READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THIS IS AN ASSUMPTION OF RISK/RELEASE OF LIABILITY, A WAIVER OF CLAIMS AND AN AGREEMENT NOT TO SUE. THIS CONTRACT IS ENTERED INTO BETWEEN MYSELF, AND FOR THE BENEFIT OF OTHERS PREVIOUSLY DESCRIBED.
