I have voluntarily applied with Clayton County Humane Society, Inc., and/or its affiliates and in doing so, I agree to comply with all rules and regulations established by Clayton County Humane Society, Inc. and I understand that failure to do so may result in my immediate termination as a volunteer. As a volunteer, I agree to do my best to represent Clayton County Humane Society, Inc. to the public in an accurate and professional manner. I acknowledge that my services are provided strictly on a volunteer basis, without pay or compensation of any kind, and without liability of any nature on behalf of Clayton County Humane Society, Inc. and all services are to be performed at my own risk.*

Volunteer Certification of Capacity: I certify that I am physically and mentally capable of safely participating in volunteer activities with Clayton County Humane Society, Inc. I agree to perform only those tasks for which I am qualified, trained, or instructed, and to immediately inform a Clayton County Humane Society supervisor if I experience any medical condition, limitation, or restriction that may affect my ability to safely volunteer. I acknowledge that I am responsible for managing my own health and well-being during volunteer service and will notify Clayton County Humane Society, Inc. if any circumstances arise that may limit or impact my ability to volunteer safely.*

I understand that working with or handling wild, feral, and domesticated animals, including unvaccinated animals, as well as performing other volunteer tasks, carries inherent risks including physical harm. I am voluntarily participating in these activities wiht full knowledge of the tasks and risks involved. These risks may include, but are not limited to, bites, scratches, kicks, violent attacks, allergic reactions, and zoonotic diseases (diseases that can be transmitted from animals or wildlife to humans). I also recognize that exposure to chemical cleaning products while performing my volunteer duties may pose additional risks. I understand that accidents or injuries may occur, and I will seek any necessary medical attention using my own health insurance. I further acknowledge that if I am or become pregnant, or if I have a medical condition that compromises my immune system, I should consult my doctor and obtain approval before volunteering with rescue animals. I fully understand and voluntarily accept these risks and dangers.*

I understand that transporting animals, supplies, or food may involve risks such as accidents, property damage, or injury. When I use my personal vehicle for Clayton County Humane Society activities, I acknowledge that my personal auto insurance is primary in the event of an accident.*

I understand that as a volunteer I may be asked to use or assist with the use of tools, machinery, and equipment of any kind, including but not limited to cages, cleaning supplies, kennels' hand tools, power tools, landscaping equipment, demolition tools, and other devices (such as sledgehammers, woodchippers, lawnmowers, chainsaws, and weedeaters). I agree to use all such tools and equipment safely, follow instructions, and immediately report any unsafe conditions to a Clayton County Humane Society supervisor. I acknowledge that improper or accidental use of such tools may result in serious injury, and I voluntarily assume these risks.*

I understand that as a volunteer I am not covered by workers9 compensation insurance. However, Clayton County Humane Society provides accident insurance for registered volunteers, which may cover certain medical expenses if I am injured while volunteering, subject to policy limits and exclusions.*

I agree that Clayton County Humane Society, Inc. may use my name, and pictures, photographs, or video and/or sound recordings of me on television, on radio, on the internet, in emails, social media, in stories, news articles, advertisements, or other written or digital materials. I agree that such uses may include education, advocacy, and fundraising. I consent to and authorize, in advance, such use and agree that Clayton County Humane Society, Inc. does not have to notify me of such use or provide me with other consideration for such use. I waive any rights of privacy and/or publicity I may have in connection with these uses and I hereby release any such photographs to Clayton County Humane Society, Inc. for use in its programs, publications, social media, and other purposes.*

Release of LiabilityIn consideration for being permitted to volunteer with Clayton County Humane Society, Inc., I knowingly and freely assume all risks, whether known or unknown, associated with my volunteer activities. I hereby fully and forever release, waive, discharge, and hold harmless Clayton County Humane Society, Inc., its officers, directors, employees, agents, members, promoters, advertisers, volunteers, contractors, sponsors, property owners, lessees, and affiliated organizations (including but not limited to Hollywood Feed , Petsmart, and Petsmart Charities), together with their officers and employees, heirs, executors, administrators, and successors, from any and every claim, demand, right of action of any kind or nature, liability, injury, loss, damage, death, or cause of action, either in law or in equity, arising from or by reason of any bodily injury, personal injury (known or unknown), death, and/or property damage resulting from or to result from any accident that may occur as a result of volunteering or working with the animals cared for by Clayton County Humane Society, Inc.I acknowledge that I am waiving legal rights that I may have now or in the future, whether known or unknown, for injury, death, or damage arising out of or related in any way to my volunteer duties, whether arising from the ordinary negligence of Clayton County Humane Society or its representatives or otherwise, to the fullest extent permitted by law. This release does not apply to gross negligence, reckless conduct, or intentional harm.I further agree not to sue, prosecute, or make any claim against Clayton County Humane Society, Inc. or its representatives for any injury to me, or damage to my property, arising out of my volunteer activities. This release extends to and is binding upon my heirs, executors, administrators, successors, and assigns.*

I agree that this Waiver and Release of Liability protects and is for the benefit of Clayton County Humane Society, Inc., and for its affiliates, and their respective employees, officers, directors, consultants, interns, volunteers, licensees, and all others acting on their behalf. I also agree that I may not make any claim or take any action against any of those affiliates or individuals that I could not make or take against Clayton County Humane Society, Inc. itself.*

To the extent that legal consideration is required for this Waiver and Release of Liability to be effective, I agree that I have received good, valuable and sufficient consideration by being permitted by Clayton County Humane Society, Inc. to provide volunteer service and to receive training and instruction.*

(If I am under 18 years of age at the time of registration, my parent or legal guardian has completely reviewed this Waiver and Release of Liability, understands and consents to its terms, and authorizes my participation.)*

Severability Clause:

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law/Venue:

This Waiver shall be governed by and construed under the laws of the State of Georgia, and any disputes shall be resolved exclusively in the courts of Henry County, Georgia.

Legal Disclaimer
This Waiver and Release of Liability is intended to be as broad and inclusive as permitted by the laws of the State of Georgia. If any portion of this Waiver is held invalid or unenforceable, the remainder shall continue in full legal force and effect. I understand and expressly agree that this Waiver is binding upon me, my heirs, executors, administrators, successors, and assigns.
