I wish to participate on the recreational charter boat excursion or guided beach adventure being operated by a third party company booking through Shore Excursions Group, and I acknowledge that my participation is completely voluntary. I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH BOATING / SNORKELING / DIVING, ETC., including, but not limited to equipment failure, perils of the sea, harm caused by other vessels, acts of fellow participants, entering and exiting the water, boarding or disembarking boats, and activities on the docks and beaches. I fully assume responsibility for my own safety (including, without limitation, following all directions of the boat's captain and crew) while participating. I also verify that I am physically able to participate in these activities. I will not hold the third party company responsible for any recurrence of my previous injuries, if any. I fully understand that the involved boat has limited medical facilities and that in the event of illness or injury appropriate medical care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions. No person associated with the third party company has made any express or implied representation to me that they or the boat's crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid I would like assistance and will not hold any person or entity responsible for their actions in attempting the performance or rescue or first aid. In the case of a minor Participant, I, as parent or legal guardian, acknowledge that I am not only signing this Agreement on my behalf, but that I am also signing on behalf of the minor and that the minor shall be bound by all of the terms of this Agreement. Additionally, by signing this Agreement as the parent or legal guardian of a minor Participant, I understand that I am also waiving certain rights on behalf of the minor that the minor otherwise may have. I agree that but for the foregoing, the minor Participant would not be permitted to participate in the Activity and sign this document out of desire to have the Participant be allowed to participate in the Activity. I represent that I am a legal parent or guardian of the minor Participant. Having read this wavier, I agree to RELEASE from LIABILITY and HOLD HARMLESS the third party company along with its respective officers, directors, employees, owners, members, managers, affiliates, agents, representatives, attorneys, heirs, personal representatives, successors and assigns, all associated individuals, and all individuals and entities having an interest in the boats being used, from any and all liability, claims, demands, equitable relief, damages, costs, expenses, and causes of action of any kind or character, of any type or nature whatsoever (including negligence), that may arise. I certify that I have read this document and agree with its contents.
