INCORPORATION OF SERVICES & PRICING

This Agreement incorporates by reference the specific event details, service types, and total fees selected by the Client in the DVPIX Pricing & Services Sheet.

Final Balance: The remaining payment is due immediately upon completion of on-site services.
Late Payment: Per CA SB 988, payments not received by the due date are subject to statutory penalties, including double damages if unpaid after 30 days.

LIVE PRODUCTION & DELIVERY

Real-Time Access & Curation: A DVPIX assistant proactively deletes blurry or inappropriate photos from the live Gallery, which constitutes final delivery, and the Client may request the removal of specific images during or after the event. This curation (deleting photos) is the only editing provided; no Photoshop or post-processing is included
Live Overlays: If requested, custom digital frames will be applied live. Client must provide or approve design assets 48 hours prior to the event start time.
Archiving: The live gallery link will remain active for a minimum of 6 months following the event.

EXPENSES & COOPERATION

San Francisco: No travel or parking fees apply for locations within SF city limits.
Outside SF: The Client and DVPIX will agree upon a flat fee covering all travel-related expenses.
Cooperation: The photographer is not responsible for missed shots resulting from the Client’s failure to provide reasonable assistance or cooperation.

LEGAL & PRIVACY

Authenticity Guarantee: Photographer provides "Live" photography representing a factual record. No generative AI is used to alter the physical reality or subjects of the images.
Safety: The photographer reserves the right to cease work immediately without refund if they encounter hostile, threatening, or offensive behavior.
Liability: Total liability for technical failure or data loss is limited to a refund of fees paid by the Client.
Usage & AI Training: Photographer retains all copyrights. Client is granted a non-exclusive license for personal use. While digital overlays may be AI-assisted, the use of images of people or event scenes for training AI models is strictly prohibited.
Connectivity Disclaimer: Real-time delivery is dependent on cellular or WiFi signal. DVPIX is not liable for delivery delays or failures caused by inadequate venue connectivity or cellular dead zones. In such instances, the "Live" gallery will be updated once a stable connection is established.

Agreement: I understand that a 25% retainer is required to secure the date and is only refundable if cancellation notice is provided 30 days or morePrivacy Policy: Images will never be used for AI model training.
