This Confidentiality and Data Protection Agreement (“Agreement”) is entered into between Camino Rising, an Illinois not-for-profit corporation (the “Corporation”), and the undersigned volunteer (“Volunteer”).
1. Purpose
The Volunteer may receive, access, or handle sensitive personal information in connection with the administration of the DPMP Mutual Aid Fund. This Agreement establishes confidentiality obligations and data protection standards consistent with Illinois law and the Corporation’s internal governance policies.
2. Definition of Confidential Information
“Confidential Information” includes, but is not limited to:
- Applicant names and identifying information
- Contact information
- Financial circumstances
- Family information
- Legal matters
- Immigration-related circumstances
- Intake summaries and internal review notes
- Funding determinations
- Any non-public personal data collected through intake or review
Confidential Information may exist in written, electronic, verbal, or digital format.
3. Non-Disclosure Obligation
The Volunteer agrees:
- Not to disclose Confidential Information to any unauthorized person.
- Not to discuss applicant information outside authorized review settings.
- Not to share data via personal email, messaging platforms, or social media.
- Not to remove physical or digital records from authorized systems.
Disclosure is permitted only:
- To authorized representatives of Camino Rising for legitimate review purposes; or
- As required by law.
4. Data Handling and Security
The Volunteer agrees to:
- Access information only as necessary to perform assigned duties.
- Use secure systems designated by the Corporation.
- Avoid downloading or storing applicant information on personal devices unless expressly authorized.
- Immediately report any suspected data breach or unauthorized disclosure.
5. Conflict of Interest
If the Volunteer has a personal, financial, or familial relationship with an applicant, the Volunteer must:
- Disclose the relationship immediately; and
- Recuse themselves from review or discussion of that request.
6. No Independent Authority
Volunteers:
- May not promise or imply guaranteed funding.
- May not independently approve assistance.
- May not speak on behalf of the Corporation unless authorized.
7. Duration of Obligation
Confidentiality obligations:
- Begin upon signing this Agreement; and
- Continue indefinitely, including after the Volunteer’s service ends.
8. Return or Destruction of Materials
Upon request or termination of service, the Volunteer agrees to:
- Return all documents; or
- Permanently delete electronic materials;
- Certify destruction if requested.
9. Remedies
Violation of this Agreement may result in:
- Immediate removal from volunteer duties;
- Board review;
- Possible legal remedies as permitted under Illinois law.
10. Acknowledgment
By signing below, the Volunteer acknowledges:
- They have read and understand this Agreement.
- They agree to comply fully with its terms.
- They understand the sensitive nature of the information involved.
