TO: Eagle Point-Blue Rapids Parks Council (EPBR Parks Council), its Directors, Officers, Employees, Representatives, Instructors, Volunteers, and Agents (collectively called the “Agents”).

In consideration of participating in any EPBR Parks Council programs, events, courses, and workshops (the "Program"), I, the undersigned participant (or legal guardian, if applicable), acknowledge and agree as follows:

Acknowledgement of Risks
I understand that there are inherent risks, hazards, and dangers in participating in activities, particularly in an outdoor environment. These include, but are not limited to:

• Exposure to variable extremes in weather, which may cause injury due to heat or cold.
• Remote locations with poor communication and limited access to rescue or medical assistance.
• Potential injuries from the use of knives, sharp objects, and fire-building.
• Potential injuries from travel on frozen waterways.
• Potential injuries sustained through participating in this program.

EPBR Parks Council and its Agents will exercise due diligence and care to assure risks are minimized to the partition.

Waiver of Liability

1. I am voluntarily participating in the Program and agree to accept all risks, including the possibility of death, personal injury, property damage, and/or loss resulting from my involvement.
2. I have freely accepted responsibility for accidents to myself arising from the hazards and risks inherent to outdoor programs, which include, but are not limited to: steep, uneven, slippery or jagged terrain, insects, dangerous animals, forest deadfall, stumps, dense brush, branches, ice, snow, weather conditions (including hot, windy, cold, or wet weather), outdoor gear and equipment, and motorized vehicles.
3. I knowingly and intentionally waive, release, indemnify, and hold harmless EPBR Parks Council and its Agents from all claims, actions, causes of action, liabilities, suits, costs, expenses (including legal fees), and demands of any nature whatsoever, which arise from my participation in the Program, including negligence by EPBR Parks Council or its Agents.
4. I certify that I am physically capable and fit to participate in the Program and assume full responsibility for my physical fitness and capacity to undertake the activities involved.
5. I understand and agree that EPBR Parks Council reserves the right to refuse participation, without penalty or refund, to any individual who, at its sole discretion, is deemed to be a hazard to themselves, other participants, staff, or animals.

Authorization for Medical Treatment

1. In the event of accident, injury, or illness affecting me during the Program, I authorize EPBR Parks Council and its Agents to arrange medical treatment on my behalf, including admission to a hospital and necessary procedures. I understand that EPBR Parks Council and its Agents are not responsible for medical costs incurred.

Legal Acknowledgements

1. I agree that this Agreement limits the liability of EPBR Parks Council’s Agents to the same extent as it limits the liability of EPBR Parks Council, even though the Agents are not formal parties to this Agreement.
2. I agree that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
3. I confirm that I am not relying on any oral or written representations or statements made by EPBR Parks Council or its Agents, other than those explicitly set forth in this Agreement, to induce me to participate in the Program.
4. I agree that the laws of the Province of Alberta govern this Agreement.

Indemnity

1. I agree to indemnify and hold harmless EPBR Parks Council and its Agents from any legal fees and costs incurred in enforcing this Agreement.

Confirmation of Understanding

1. I confirm that I have read this Agreement, clearly understand its terms, and agree that it is binding on myself, my estate, heirs, next of kin, executors, administrators, and assigns.
