The mare owner understands that they must comply with the following;
1. Orders for fresh cooled semen must be made by email to OneTimeUpNorth@outlook.com by 4pm on the day prior to collection. Collections days are Monday, Wednesday and Friday. North’s show schedule may affect availability of fresh semen on rare occasions.
2. A signed copy of this contract, a copy of the mare’s registration papers and payment of the breeding fee must be sent to OneTimeUpNorth@outlook.com prior to collection.
3. Up North Performance Horses has engaged Deerpath Breeding and Development to collect, process and ship semen from One Time Up North. These parties only assume responsibility to ship semen in viable condition and shall not be held liable for contamination or damage to semen during and after shipment, loss of viability, or any costs arising from shipments delayed, damaged or lost in transit, or any injury, disability or death of horse or human participating in equine breeding activities.
4. Mare owner agrees to use all semen provided for the mare named in this agreement and no other. Confirmed pregnancy/open status to be reported to OneTimeUpNorth@outlook.com by October 1 of the breeding year. The number of ET pregnancies must also be reported.
5. Breeders Certificates will be released online after the account is paid in full. Hardcopies mailed upon request. Please notify OneTimeUpNorth@outlook.com of the birth of the foal.
6. Live foal guarantee. Live foal means the foal shall stand and nurse without assistance. It is understood that if the mare proves barren, aborts her foal, or if a foal is stillborn, a return breeding will be guaranteed the following year only, providing that proper notification is received within 7 days of the occurrence. Breeder does not make any warranty or representation as to the quality or conformation of the foal, merchantability or fitness for a particular purpose, or that the foal will be free of any infirmity, conformation defect, disease or inherited trait.
7. Rebreeds. If the mare does not produce a live foal the first breeding season, the mare owner is entitled to rebreed the following year, subject to chute and shipping fees at the new year rate. If the mare owner fails to breed the mare the following year, then any and all fees paid shall be forfeited, the right to rebreed is cancelled and the stallion owner is released from all further obligation of the contract, unless otherwise agreed to in writing and signed by all parties.
8. The contract is a binding agreement between the mare owner and stallion owner and is nontransferrable unless agreed to in writing by all parties. Any transferred breedings will incur an additional chute fee and completed paperwork by the new contract holder.
9. The mare owner agrees that the mare contracted for breeding is in sound breeding condition.
10. Should One Time Up North become unfit for service for any reason, then this contract shall become null and void and both parties are relieved of any further obligation. Any monies paid by the mare owner toward the stallion fee shall be refunded.
11. This contract becomes valid and binding upon signature by both the mare owner and a representative of Up North Performance Horses. A signed copy of this contract will be provided to the mare owner upon receipt of payment for breeding fee.
