  • Independent Contractor Status

    Subcontractor is an independent contractor and not an employee. Subcontractor is responsible for all taxes, employees, equipment, licensing, and insurance.

    Indemnification

    Subcontractor agrees to defend and indemnify the marina, its owners, employees, and agents from claims arising out of subcontractor work, negligence, or violations of law.

    Damage Responsibility

    Subcontractor is fully responsible for any damage caused to vessels, docks, travel lifts, equipment, or marina property.

    Environmental Compliance

    All subcontractors must comply with Maryland Department of the Environment regulations and marina environmental policies regarding hazardous materials, sanding dust containment, fuel handling, and waste disposal. Any spills must be reported immediately to the marina office.

    Work Authorization

    No subcontractor may begin work without authorization from marina management.

    Insurance

    Prior to performing any work, subcontractors must provide a Certificate of Insurance meeting the following minimum requirements:
    Liability: $1,000,000 per occurrence
    Workers Compensation: As required by Maryland law, if the business has employees.
    "Higgins Yacht Yard Marina Inc" must be listed as Additional Insured.
    Policy must remain active during the duration of all work.

    IRS Form W9

    All subcontractors must submit a completed IRS Form W-9 prior to beginning any work. This information will be used for tax reporting purposes.

    Boatyard/Marina Rules

    All subcontractors must comply with marina operational rules including:

    1. Boat stands shall not be moved, unchained, repositioned, or otherwise disturbed by anyone other than HYY personnel.
    2. For safety reasons, OWNER shall not be aboard the vessel while it is in the travel lift slings.
    3. Mast climbing, mast removal, and/or raising of sails while any vessel is in the yard or on the property of HYYM is prohibited.
    4. For liability purposes, HYYM does not loan and/or rent tools, ladders, extension cords, or any other equipment.
    5. All disposal or hazardous material must be in accordance with local, state, and federal regulations.
    6. Boat covers shall not be fastened to jack stands in any way. HYY reserves the right to retie any covers found in such a way at OWNER expense.
    7. Dry stored vessels shall not be left plugged into shore power while unattended. All batteries must be either disconnected, or master switches turned off.
    8. No heaters nor portable battery chargers are allowed on any unattended vessels.
    9. Subcontractors must only work in designated areas, maintaining a clean work area, and not interfere or block any operations of HYYM.
    10. Subcontractors must follow designated work hours.
