RIDE & DRIVE TEST-DRIVE PARTICIPANT CONSENT AGREEMENT & WAIVER
Notice – While riding in or operating vehicles: Follow all instructions and directions of staff, manufacturers, volunteer vehicle owners, and their agents and stay on the set course.
I understand that my participation in this EV Test Drive and/or E-bike Test Ride Event is subject to the conditions in this Agreement.
Insurance Responsibility: I acknowledge that my personal auto insurance is primary and will be used in the Event of any incident or accident during the test drive.
Test Drive Supervision: I agree that test drives of volunteer-owned vehicles will be conducted only with the owner present in the vehicle at all times.
No Representations: None of the sponsors have made any representations to me about the condition of the vehicles or the premises where I will be participating in these activities.
Assumption of Risk and Release of Liability: On behalf of myself and/or minor child (if applicable), I accept the risks, dangers and hazards presented by participating in this Event. I acknowledge and accept all risk of harm known and unknown, and risk of injury to myself, my minor child, as well as damage to property and even death, which may result from participating in this Event. On behalf of myself, my minor child, legal representatives, heirs, and assigns I hereby release Ecology Action, the City of Salinas, Electrify America, their respective officials, officers, directors, employees and agents; vehicle manufacturers, vehicle dealerships and providers, owners, lessees or lessors, and their respective employees, officers, directors, affiliates, members, shareholders, and agents (“Sponsors”) from and against any and all claims, demands, losses, damages or liability of any kind or nature which may arise out of participation in this activity.
Indemnification: I agree, to the fullest extent permitted by law, to indemnify, defend, and hold harmless the Sponsors from and against all claims, causes of action, liabilities, and damages for injuries to persons and property, including costs of defense and reasonable attorney fees, arising from my participation in this Event; provided, however, that I shall not have any obligation to indemnify, defend, or hold harmless for any claims arising from the sole and active negligence or willful misconduct of the Sponsors.

PRUEBA DE CONDUCCIÓN Y MANEJO - ACUERDO DE CONSENTIMIENTO Y EXENCIÓN DE RESPONSABILIDAD PARA PARTICIPANTES EN PRUEBAS DE MANEJO
Aviso: Mientras esté conduciendo o viajando en vehículos: Siga todas las instrucciones y directrices del personal, fabricantes, propietarios voluntarios de vehículos y sus agentes, y manténgase en el recorrido establecido.
Yo entiendo que mi participación en esta Prueba de Manejo de Vehículos Eléctricos y/o Paseo de Prueba de Bicicleta Eléctrica está sujeta a las condiciones de este Acuerdo.
Responsabilidad de Seguro: Reconozco que mi seguro de automóvil personal es primario y se utilizará en caso de cualquier incidente o accidente durante la prueba de manejo.
Supervisión de la Prueba de Manejo: Estoy de acuerdo en que las pruebas de manejo de vehículos propiedad de voluntarios se realizarán únicamente con el propietario presente en el vehículo en todo momento.
Sin Representaciones: Ninguno de los patrocinadores me ha hecho ninguna declaración sobre el estado de los vehículos o las instalaciones donde participaré en estas actividades.
Asunción de Riesgos y Exoneración de Responsabilidad: En mi nombre y/o en el de mi hijo menor (si corresponde), acepto los riesgos, peligros y eventualidades que implica participar en este Evento. Reconozco y acepto todo riesgo de daño, conocido y desconocido, y riesgo de lesión para mí mismo, para mi hijo menor, así como daños a la propiedad e incluso la muerte, que puedan resultar de participar en este Evento. En mi nombre, en el de mi hijo menor, representantes legales, herederos y cesionarios, por la presente libero a Ecology Action, la Ciudad de Salinas, Electrify America, sus respectivos funcionarios, directivos, empleados y agentes; fabricantes de vehículos, concesionarios y proveedores de vehículos, propietarios, arrendatarios o cedentes, y sus respectivos empleados, directivos, directores, afiliados, miembros, accionistas y agentes (“Patrocinadores”) de cualquier y toda reclamación, demanda, pérdida, daño o responsabilidad de cualquier tipo o naturaleza que pueda surgir de la participación en esta actividad.
Indemnización: Estoy de acuerdo, en la máxima medida permitida por la ley, en indemnizar, defender y eximir de responsabilidad a los Patrocinadores frente a todas las reclamaciones, causas de acción, responsabilidades y daños a personas y bienes, incluidos los costos de defensa y honorarios razonables de abogados, que surjan de mi participación en este Evento; siempre y cuando, sin embargo, no tendré ninguna obligación de indemnizar, defender o eximir de responsabilidad por cualquier reclamación que surja de la negligencia exclusiva y activa o mala conducta intencional de los Patrocinadores.
