LIABILITY WAIVER AND RELEASE OF CLAIMS
This Liability Waiver and Release of Claims ("Agreement") is entered into by the undersigned participant (or participant’s parent/legal guardian if under 18) in favor of E22 Academy, Coach Edu 22, Sunion Indoor, Pikaxu EnterprisesLLC, Xarizart EnterprisesLLC, and their respective officers, directors, employees, agents, affiliates, volunteers, successors, and assigns (collectively, the “Released Parties”).
1. Acknowledgment of Risk
I acknowledge that participation in soccer, sports, and related physical activities involves inherent risks including, but not limited to: personal injury, property damage, illness (including communicable diseases like COVID-19), permanent disability, or death. I understand these risks may result from my own actions or inactions, or the actions or inactions of others.
2. Assumption of Risk
I voluntarily choose to participate (or allow my child to participate) in the activities offered by the Released Parties at facilities including, but not limited to, Sunion Indoor, Club Ohio Indoor, 614Soccer LLC and TG Sports Galacticos, and acknowledge that I assume all associated risks.
3. Waiver and Release
In consideration for being allowed to participate in any activity associated with the Released Parties, I hereby voluntarily waive, release, and discharge the Released Parties from any and all claims, demands, liabilities, causes of action, damages, or expenses (including attorney fees) of any kind, whether known or unknown, arising out of or in connection with my (or my child’s) participation in the activities.
This release includes claims of negligence, but does not extend to acts of gross negligence, reckless misconduct, or intentional wrongdoing.
4. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims brought by or on behalf of myself, my child, or any third party, relating to injuries, damages, or losses allegedly caused by or resulting from participation in any activity organized by the Released Parties.
5. Medical Treatment
I authorize the Released Parties to secure medical treatment for me or my child in the event of an emergency and agree to pay all costs associated with such treatment.
6. Media Release
I consent to the use of photographs, video, and other media taken during participation for promotional, educational, or other lawful purposes, without compensation.
7. Severability
If any part of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any legal action shall be brought exclusively in a court of competent jurisdiction in Ohio.
We further state that I/we have fully and carefully read the above release, understand the contents of the same and sign this release voluntarily and as my/our own free act and deed.
