Parent / Guardian Waiver and Release of Liability

This waiver must be completed by the parent or legal guardian of the participating child. By signing this document, you are giving consent for your child to participate in FX Beach: Kids, acknowledging the inherent risks of the activity, and releasing Sound.Wav Collective LLC dba Functional Human from liability to the fullest extent permitted by Florida law. Please read every section carefully before signing.

Please provide a secondary emergency contact in case you cannot be reached during a session.

FX Human staff will only release your child to the parent or guardian listed in Section 2, or to the individuals listed below. Please list all adults authorized to pick up your child. Authorized individuals may be asked to show photo ID.

Please answer the following honestly and thoroughly. This information is used solely to ensure your child's safety during sessions and to allow our instructor to provide appropriate modifications. This is not a medical intake form and Sound.Wav Collective LLC dba Functional Human does not provide healthcare services.

FX Beach: Kids is an outdoor group fitness and movement program held on public beaches in Sarasota County, Florida. The program is designed for children ages 8–11 (3rd–5th grade) and emphasizes cooperative play, agility, coordination, functional movement, and teamwork.

Sessions may include:

• Running, jumping, crawling, and dynamic movement on sand
• Agility drills using cones, hurdles, and markers
• Cooperative games and team challenges
• Balance and coordination activities
• Resistance band exercises appropriate for youth
• Medicine ball activities scaled to age and ability
• Partner and group games involving physical contact and tag-style play
• Breathwork and brief mindfulness exercises

Sessions take place outdoors on sand and participants will be exposed to sun, heat, humidity, wind, and uneven terrain. Sessions are scheduled in the early morning to minimize heat exposure. Children should arrive with sunscreen already applied, wearing athletic clothing appropriate for the beach, and bringing a full water bottle.

I, the undersigned parent or legal guardian, understand and acknowledge that participation in FX Beach: Kids involves inherent risks, including but not limited to:

• Physical exertion that may strain muscles, joints, or the cardiovascular system
• Falls, trips, collisions, or loss of balance on sand or uneven terrain
• Contact with other participants during cooperative games and group activities
• Exposure to heat, sun, humidity, and outdoor weather conditions
• Use of age-appropriate fitness equipment including resistance bands, medicine balls, agility hurdles, and cones
• Insect activity, marine life, and other environmental factors present at public beach locations
• Unforeseen hazards inherent to outdoor beach environments

I voluntarily assume all risks associated with my child's participation, whether known or unknown, foreseeable or unforeseeable, on behalf of myself and my child.

In consideration of my child being permitted to participate in FX Beach: Kids programming offered by FX Human, I, as parent or legal guardian, hereby release, waive, discharge, and covenant not to sue FX Human, its owners, instructors, employees, volunteers, and agents (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by my child while participating in this program or while on or near the premises where the program is conducted, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by Florida law.
I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of my child arising from participation in the program.

In the event of an injury or medical emergency, I authorize FX Human staff to:

• Administer basic first aid as needed
• Call 911 and emergency medical services
• Contact me or the emergency contacts listed in this waiver
• Consent to emergency medical treatment if I cannot be reached in time

I understand that FX Human staff are not licensed medical professionals and that any first aid provided is limited to basic care while awaiting emergency services. I accept financial responsibility for any emergency medical treatment rendered to my child.

If yes, please provide a copy to FX Human staff before your child's first session.

FX Beach: Kids sessions are held outdoors in Sarasota County, Florida. Heat and sun exposure are inherent to the program. To protect your child:

• Please apply sunscreen to your child before arriving at every session
• Your child must bring a labeled water bottle to every session
• Children will be encouraged to hydrate throughout the session
• FX Human staff will monitor participants for signs of heat-related illness
• Any child showing signs of heat exhaustion will be removed from activity immediately and parents will be contacted

By signing this waiver, I acknowledge that I have read and understood this policy and agree to prepare my child accordingly.

FX Beach: Kids is built on a foundation of respect, cooperation, and fun. We expect all participants to treat fellow participants, instructors, and the beach environment with respect. The following behaviors may result in a child being removed from the session:

• Deliberate physical aggression toward another participant or instructor
• Persistent refusal to follow safety instructions from FX Human staff
• Bullying, taunting, or exclusionary behavior toward other participants
• Behavior that poses a risk to the safety of the child or others

FX Human staff will always attempt to redirect behavior positively before escalating. Parents will be contacted if a child's behavior requires removal from a session. No refunds will be issued for removal due to behavioral issues.

By signing below, I confirm that I have reviewed these expectations with my child and that my child understands and agrees to participate respectfully.

FX Human maintains a 1:10 instructor-to-participant ratio at all sessions to ensure adequate supervision. However, please be aware of the following:

• Sessions take place on a public beach. FX Human is not responsible for the actions of members of the general public outside of the designated program area
• FX Human staff supervise participants only during the scheduled session window (8:00 AM - 9:15 AM). Children must be picked up at session end
• Children will not be released to anyone not listed on this waiver
• If a parent or authorized adult is more than 15 minutes late for pickup, FX Human staff will attempt to contact the emergency contacts listed on this form

FX Human photographs and video records sessions for use in marketing materials, social media, and promotional content. Photos and videos may feature participants including children.

If you wish for your child not to appear in photos or videos, please let us know at or before your child's first session. We will provide your child with a small colored wristband to wear during sessions so that our instructors and editors know to blur or exclude your child from all photos and video content during editing.

By signing below, I confirm that:

• I am the parent or legal guardian of the child named in Section 1 and have the legal authority to sign this waiver on their behalf
• I have read this entire document carefully and fully understand its contents
• I understand that this is a legally binding waiver and release of liability
• I voluntarily enroll my child in FX Beach: Kids and assume all risks associated with their participation
• All health information provided in this waiver is accurate and complete to the best of my knowledge
• I agree to notify FX Human immediately if my child's health status changes in any way that may affect their safe participation
• I have reviewed the behavior expectations and drop-off policy with my child
