WAIVER AND RELEASE OF LIABILITY
MARKAR A SOCCER ACADEMY, INC. – PLAYER TRYOUTS & TRAINING SESSIONS
In consideration of being permitted to participate in soccer tryouts, training sessions, and related activities organized by Markar A Soccer Academy, Inc. (“Academy”), the undersigned participant and/or parent or legal guardian agrees as follows:
1. Acknowledgment and Assumption of Risk
I understand that participation in soccer activities, including but not limited to tryouts, practices, scrimmages, conditioning, and use of athletic facilities, involves inherent risks of injury, including but not limited to Sprains, strains, fractures, and other musculoskeletal injuries head injuries, concussions, and bodily trauma illness or exposure to contagious diseases injuries caused by equipment, playing surfaces, or other participants
I voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in these activities.
2. Waiver and Release of Liability
To the fullest extent permitted by California law, I hereby release, waive, discharge, and covenant not to sue Markar A Soccer Academy, Inc., including its: directors, officers, coaches, employees, volunteers, agents, representatives ,affiliates (collectively referred to as the “Released Parties”) from any and all claims, demands, damages, liabilities, or causes of action, including those arising from ordinary negligence, related to or arising from participation in the Academy’s activities.
This release applies to personal injury, illness, property damage, or death that may occur during participation in tryouts or any related activity.
This waiver does not apply to claims arising from gross negligence or willful misconduct, as required under California law.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorney fees) arising from the participant’s actions or participation in the Academy’s activities.
4. Medical Authorization
I authorize Markar A Soccer Academy and its representatives to obtain emergency medical treatment for the participant if necessary, during participation.
I understand that:
Reasonable efforts will be made to contact the parent/guardian or emergency contact.
Emergency medical care may be provided without prior contact if circumstances require immediate attention.
I agree to be financially responsible for any medical expenses incurred as a result of injury or illness.
5. Physical Fitness Representation
I certify that the participant is physically fit and capable of participating in athletic activities and has no medical condition that would prevent safe participation.
If the participant has a medical condition, I agree to notify the Academy prior to participation.
6. Compliance with Rules
The participant agrees to follow all rules, instructions, and safety guidelines established by Markar A Soccer Academy and its coaching staff. Failure to comply may result in removal from the activity.
7. Photography and Media Release
I grant Markar A Soccer Academy the irrevocable right and permission to photograph, record, and use the participant’s name, image, likeness, and voice for promotional materials, social media, marketing, educational and archival purposes
No compensation will be provided for such use.
8. Parent/Guardian Consent for Minors
If the participant is under 18 years of age, this waiver must be signed by a parent or legal guardian.
The parent/guardian acknowledges that they:
- Have read this agreement
- Understand its contents
- Accept full responsibility for the minor’s participation
9. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of California.
10. Severability
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
