Before WQED can use the content you submit, we need you to confirm that you own the content and that you are granting WQED permission (a license) to use it.
By submitting content through this form, you (“Contributor”) grant WQED Multimedia, a Pennsylvania nonprofit corporation located at 4802 Fifth Avenue, Pittsburgh, PA 15213 (“WQED”), the rights described below.
1. Content Submission
You are submitting video, audio, images, or other materials (the “Content”) for possible use by WQED on its television and radio broadcasts, websites, social media channels, mobile applications, and other digital or media platforms now known or later developed (collectively, the “Platforms”).
2. Ownership and Permissions
You represent and warrant that:
- you are at least 18 years old, or a parent or legal guardian submitting on behalf of a minor
- the Content is an original recording created by you
- you own the Content or have all necessary rights and permissions to grant the license described in this agreement
- the Content does not infringe the rights of any third party
- the Content does not include copyrighted material owned by others unless you have express permission of the copyright owner to use it.
- the Content does not include any impersonation, synthetic media, or AI-generated representations of real individuals (including voice or likeness)
- any individuals appearing in the Content have consented to be recorded and to WQED’s use of the Content
If any person under the age of 18 appears in the Content, you represent that you are the parent or legal guardian of that person or have obtained parental consent for their appearance.
3. License Grant
You grant WQED and its affiliates a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, edit, adapt, display, distribute, broadcast, publish, and otherwise use the Content on the Platforms, including in promotional and marketing materials.
This license includes the right for WQED to edit the Content and combine it with other materials.
4. No Obligation to Use Content
WQED is not obligated to use the Content and may remove or discontinue use of the Content at any time.
5. No Compensation
Submission of Content is voluntary. You understand that you will not receive compensation for WQED’s use of the Content.
6. Indemnification
You agree to indemnify and hold harmless WQED and its affiliates, and their respective officers, employees, and agents, from any claims, damages, or expenses arising out of a breach of your representations in this agreement or from WQED’s use of the Content as permitted here.
7. Governing Law
This Content License Agreement shall be governed by the laws of the Commonwealth of Pennsylvania. Any dispute relating to this agreement shall be brought exclusively in the courts located in Allegheny County, Pennsylvania.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WQED’S LIABILITY ARISING OUT OF THIS CONTENT LICENSE AGREEMENT EXCEED FIVE HUNDRED DOLLARS ($500).
9. Acceptance
By submitting Content through this form, you acknowledge that you have read and agree to the terms of this Content License Agreement.
