The Sidewalk Committee is composed of the Planning & Development Department, the Office of the City Engineer (OCE), and the Mayor’s Office for People with Disabilities (MOPD).
The Committee will evaluate a complete application for requesting a fee in lieu of sidewalk construction or sidewalk modification as authorized under § 40-558.
Committee approval of any request requires documentation illustrating that § 40-559(b), § 40-559(e), or § 40-561(d) applies to a building permit.
Staff advises applicants to complete and submit this form immediately after receiving a project number, allowing time to coordinate for the sidewalk construction if the Committee denies a request.
This form requires correct and complete information.
Failure to supply accurate information may result in application delay and eventual discarding.
The applicant will need to submit a new application, and staff will process it as a new item in the order of receipt.
Changes to the sidewalk plan during permitting or future projects on the same site may require a new application.
Any sidewalk modification approval is subject to field inspections, additional requirements by OCE during permitting, and must comply with ADA requirements.
If approved by the Committee, the Fee in Lieu of Sidewalk Construction is $12 per total square footage of the required sidewalk.
Staff will inform the applicant of the fee amount after verifying all the information.
The applicant consents to pay this fee by submitting this form.
Granting a request does not set a precedent, and the Committee reviews each case on its own merits.
A complete application does not guarantee approval by the Sidewalk Committee for a request for a fee in lieu of sidewalk construction or a sidewalk modification.
