Assumption of Risk:
By participating in activities with the Hoosier Canoe and Kayak Club, (hereinafter “HCKC”), I acknowledge and understand that paddle sports carry a significant risk of property loss, injury and death. These risks include but are not limited to permanent disfigurement, loss of limbs, total loss or impaired function of organs, mental and emotional impairments, permanent paralysis and death. I acknowledge that while the HCKC promotes safety practices by members, it is me, the individual member who is responsible for learning the necessary skillset and the safety hazards and best practices for my paddling discipline in general, and for the particular activities I engage in with HCKC and other members. I acknowledge that even with adherence to the best safety practices, an expert skillset, the best gear, knowledge of local meteorology, water levels, tides and other local conditions, expert paddlers still succumb to the risks of paddling with respect to property damage, personal injury and death. Therefore, I acknowledge the risks may be mitigated but never eliminated. By signing below, I agree that I knowingly and freely accept all such risks, whether they are known or unknown, whether or not they arise from the negligence of others. I acknowledge that I assume complete personal responsibility for my safety and for the minor children in my care and custody during HCKC activities.
Release of Liability:
On behalf of myself, my heirs and assigns, personal representatives or next of kin, I hereby release and hold harmless HCKC their volunteer officers and directors, agents, members other participants, sponsoring agencies, advertisers, volunteers, coaches, and, owners and lessors of premises used for the club activities or special events for any and all, injury, illness, disability, death, or loss or damage to my person or property, or the minors under my care and custody, whether resulting from the negligence of the above persons or entities or otherwise. None of the foregoing shall be construed to release conduct intended to harm or gross negligence.
Confirmation and signature:
Submitting the form below shall represent my signature. I confirm that I have read this waiver and release of liability, fully understand its terms, and recognize that I am relinquishing substantial rights by signing it. I do so voluntarily, with knowledge and appreciation of the risks, and without reservation for myself and on behalf of the minors listed below who may be in my care and custody during HCKC events.
