FULL RELEASE AND INDEMNITY AGREEMENT

In consideration of the use of the Equipment and/or services of HIGH COUNTY PARTY, LLC as well as its agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on its behalf (hereinafter collectively referred to as "HIGH COUNTRY PARTY"), as well as its Lessees (a Lessee is a person renting the mechanical bull from HIGH COUNTRY PARTY usually the person or family of whom you are at their party), I hereby agree to release, indemnify, and discharge HIGH COUNTRY PARTY as well as any of its Lessees (who are expressly third-party beneficiaries of this Agreement) and on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate I AGREE as follows:

I acknowledge that the act of riding a mechanical bull and/or being in close proximity to another riding a mechanical bull, constitutes known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, my children or wards, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: falling off of or being thrown from the bull (or someone else falling off or being thrown into me, my children, or my property) which could result in musculoskeletal, internal-organ, brain, cardiovascular, or other medical injuries including, but not limited to, hands, feet, arms, legs, groin, torso, head, neck, and back injuries. Furthermore, I conclusively acknowledge that HIGH COUNTRY PARTY (in its renting the Equipment (e.g., mechanical bull)) or its Lessees have difficult jobs to perform in operating a mechanical bull. They seek safety, but they are not infallible and might and do make mistakes, errors, and/or omissions. They might be unaware of a participant's fitness or abilities. They may give incomplete warnings or instructions, and the equipment provided by HIGH COUNTRY PARTY being used might malfunction or break. I acknowledge that I have been given the opportunity to review and understand the Equipment's manual and/or other written instructions for operation and/or use. I can read, write, and understand the English language. I warrant and covenant that I understand such manual and/or written instructions or I waive the right to claim that I or another should have understood the same before operating and/or using the Equipment. Aside from any intentional act, the release and indemnification provisions of this agreement shall cover all acts and omissions of HIGH COUNTRY PARTY, its Lessees, as well as for any equipment malfunction(s), errors, or breakage should I sustain any injuries or damages.

I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. The entry into this agreement is my knowing, voluntary, and intelligent act.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless. HIGH COUNTRY PARTY as well as any Lessee of its Equipment from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of HIGH COUNTRY PARTY's Equipment for any such claims which allege negligent, grossly negligent, or reckless acts or omissions of HIGH COUNTRY PARTY.

Should HIGH COUNTRY PARTY, or a Lessee of any of its Equipment, or anyone acting on its/their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such actual fees and costs so long as such fees and costs are not grossly unreasonable.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. I am also willing to

sustain any property or other casualty loss, including but not limited to all real and personal property damage related to the operation and use of the Equipment and any lost wages, rents, or profits from employment or other business pursuits. Should I cause anyone damage(s) to any other person(s) and/or entity by virtue of my participation in riding the mechanical bull, I agree to fully compensate such other person(s) or entity without the need for court action.

6. In the event that I, or anyone claiming by or through me, file(s) a lawsuit(s) against HIGH COUNTRY PARTY or any of its Lessees, I agree to do so solely in the state of Idaho in Kootenai County, and I further agree that the substantive law of the state of Idaho shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

By signing this document, I acknowledge that if either I or anyone else is hurt; or, my or someone else's property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against HIGH COUNTY PARTY or any of its Lessees on the basis of any claim from which I have released them herein. I further assume full responsibility for any liability on account of losses of wages due to personal injuries or any other medical expenses or damages to myself.

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION (Must be completed for participants under the age of 18) In consideration of (print minor's name)_________________("Minor") being permitted by the Lessee of HIGH COUNTRY PARTY to participate in its activities and to use its Equipment, on behalf of myself, my spouse (if any), as well as the foregoing minor child, I agree to all of the terms above.

I further agree to indemnify and hold harmless such Lessee as well as HIGH COUNTRY PARTY from any and all Claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
