Gera Mats - Personal Training (Release of Liability)

1. PAR-Q+ HEALTH QUESTIONNAIRE ACKNOWLEDGMENT

I, the Client, confirm that I have truthfully and completely filled out the Physical Activity Readiness Questionnaire (PAR-Q+) provided by "Achieve Greatness" Personal Training prior to beginning any physical activity or training program. I understand that:

a) I have disclosed all known health conditions, injuries, medications, and physical limitations accurately in the PAR-Q+.

b) If I answered "YES" to any question on the PAR-Q+, I have obtained or agree to obtain written medical clearance from a licensed physician before participating in any training session.

c) I agree to immediately notify Gera Mats of any changes to my health status, new medical diagnoses, injuries, or medications that may arise after completing the PAR-Q+.

d) Failure to disclose accurate and complete health information releases Gera Mats and Geramats Personal Training from any liability arising from undisclosed conditions.

 

2. ASSUMPTION OF RISK

I, the Client, understand and acknowledge that participation in physical fitness training activities involves inherent risks of injury, including but not limited to: muscle strains and tears, joint injuries including sprains and dislocations, cardiovascular events, fractures, and in extreme cases, death. These risks exist regardless of the care taken by the Trainer.

I voluntarily and knowingly assume full responsibility for all risks of loss, property damage, or personal injury — including death — that may be sustained by me as a result of participating in personal training services provided by Gera Mats and "Achieve Greatness" Personal Training.

I expressly acknowledge that under Georgia law, O.C.G.A. § 51-1-29.1, this assumption of risk and release of liability is valid and enforceable to the fullest extent permitted by Georgia law.

3. RELEASE OF LIABILITY — GEORGIA SPECIFIC

In consideration of being permitted to participate in personal training services provided by Gera Mats - Personal Training, I, the Client, for myself and on behalf of my heirs, executors, administrators, personal representatives, successors, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Gera Mats - Personal Training, and their respective agents, employees, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury — including death — that may be sustained by me in connection with my use of and participation in personal training services.

I acknowledge that under Georgia law, releases of liability for personal injury resulting from negligence are enforceable so long as the intent to release is expressed in clear and unequivocal terms. I confirm this agreement meets that standard and is intended to be a complete release of all claims to the fullest extent permitted by applicable Georgia law.

I agree that if any portion of this release is held to be invalid, the remaining portions shall continue in full force and effect.

4. INDEMNIFICATION

I, the Client, agree to indemnify, defend, and hold harmless Gera Mats - Personal Training from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or relating to: (a) my participation in personal training services; (b) my breach of any representation or obligation under this Agreement; or (c) any injury I sustain due to my failure to disclose relevant health information.

5. PHOTO & VIDEO CONSENT

I understand that regardless of my choice above, any recordings made solely for the purpose of reviewing and correcting my exercise form will be deleted immediately after that coaching session.

6. INFORMED CONSENT & ACKNOWLEDGMENTS

I affirm and acknowledge the following:

• I am at least 18 years of age, or if under 18, this form has been signed by my parent or legal guardian.
• I have read this entire Agreement carefully and fully understand its contents.
• I have completed the Geramats PAR-Q+ Health Questionnaire truthfully and completely.
• I understand this is a legally binding agreement and I am voluntarily giving up significant legal rights.
• I am not relying on any oral representations made outside this document.
• I have had the opportunity to consult with legal counsel before signing if I desired to do so.
• No warranties or guarantees regarding specific fitness results have been made to me.

7. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in Georgia, and I hereby consent to personal jurisdiction in those courts.

SIGNATURES

I acknowledge that I have carefully read this form and fully understand that it is a release of liability. I expressly agree to release and discharge GERA MATS from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action for personal injury or property damage. 

By signing below, both parties agree to the terms and conditions set forth in this Agreement.
