  • VOLUNTEER AGREEMENT AND WAIVER OF LIABILITY

    “Volunteer” for purposes of this release is defined as a non-paid individual participating in activities in support of Horizon West Theater Company's mission. Activities include, but are not limited to studio construction/rennovation work, workshop or class attendance, teaching, acting, directing, set construction/strike, lighting/sound design, box office/concession sales, and work as stage/production crew during performances.

    I,  {name}  hereby voluntarily agree to participate as a volunteer for Horizon West Theater Company (the "Theater") and hereby acknowledge and agree to the terms and conditions set forth in this Volunteer Release and Waiver of Liability (the "Agreement").

    1. Assumption of Risk: I understand and acknowledge that volunteering for the Theater may involve certain risks and hazards, including but not limited to physical injury, property damage, and other unforeseen dangers. I voluntarily assume all such risks and hazards associated with my participation in the Theater's activities.

    2. Release and Waiver: In consideration of being permitted to volunteer for the Theater, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue the Theater, its directors, officers, volunteers, and agents (collectively referred to as the "Released Parties"), from any and all claims, demands, suits, actions, liabilities, expenses, or damages, whether arising in tort, contract, or otherwise, which I may have or hereafter accrue, arising from or in connection with my participation in the Theater's volunteer activities. This release and waiver include, but are not limited to, claims for personal injury, property damage, or wrongful death arising out of or in any way related to the Theater's volunteer activities, whether caused by the negligence of the Released Parties or otherwise.

    3. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against all claims, demands, suits, actions, liabilities, expenses, or damages, including reasonable attorney's fees and costs, arising from or in connection with my participation in the Theater's volunteer activities.

    4. I agree not to use any intoxicating substances—whether legal or illegal (including prescribed medications, alcohol, or cannabis)—within two (2) hours prior to reporting to the Theater (or any designated space) to participate in activities supporting the Theater’s mission. If I am under the care of a physician and taking prescribed medication that may affect my participation, I will notify a member of the production or governing team for the specific event (e.g., Instructor, Board Member, Stage Manager, Director, or Producer) and provide as much relevant information as possible. Participation in Theater activities may be limited if deemed necessary by the Instructor, Board Member, Stage Manager, Director, or Producer(s) to ensure safety. This policy is in place as a safety protocol. Violation may result in temporary or permanent suspension from participation, as determined by at least two members of the Production Leadership team or Board of Directors.

    5. Medical Treatment: I understand and acknowledge that the Theater provides limited accidental death, dismemberment, and medical expense insurance coverage for volunteers. In the event of any injury that I may suffer during my participation in the Theater's volunteer activities, I authorize the Theater, its representatives, or agents to obtain medical treatment on my behalf, including the administration of emergency medical care or transportation to a medical facility, as they deem necessary. I agree to be responsible for all initial costs associated with such medical treatment. I understand that should I wish to have the Theater file a claim on my behalf for reimbursement that the incident must meet all of the criteria, including time limits as outlined in the insurance policy.

    6. Confidentiality: I understand that during my volunteer activities, I may have access to confidential and proprietary information concerning the Theater, its operations, programs, participants, staff, and volunteers. I agree to maintain the confidentiality of such information and not to disclose or use it for any unauthorized purposes.

    7. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida in which the Theater is located. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the state or federal courts located within Orlando, Florida and I hereby submit to the personal jurisdiction of such courts.

    8. This waiver shall be effective commencing {todaysDate}, and shall remain in full force and effect for a period of three hundred sixty-five (365) days from the effective date.

    9. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    By signing below, I acknowledge that I have read this Volunteer Release and Waiver of Liability, fully understand its terms, and conditions.
