St. George Old Masters Waiver Form

This is a binding legal agreement; therefore clarify any questions or concerns
before signing.

In consideration of being allowed to participate in the activities or events of
the St. George Old Masters (“SGOM”), or the participant in any activity,
program or event and the sport of softball (collectively, the “Activities”), I (the
“Participant”) acknowledge, appreciate and agree that:

 

A) Disclaimer

  SGOM, the Participant’s League and their respective Directors, committee members, members, coaches, volunteers, officials, participants, agents, owners/operators of applicable facilities, and representatives (the “Releasees”) are not responsible for any injury, disability, death, property damage, expense, loss of income, damage or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever, including if arising from any negligence of the Releasees or others.

 

B) Risks

I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities, which may include, but are not limited to, injuries from:

1. The sport of softball;
2. Executing strenuous and demanding physical techniques, vigorous physical exertion and rapid movements, or the abrupt stoppage of movements;
3. Falls to the ground due to uneven or irregular terrain or surfaces;
4. Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;
5. Contact, colliding, falling or being struck by other participants, equipment, fences, poles or stands;
6. Grass, turf, and other surfaces, including bacterial infections and rashes;
7. Extreme weather conditions which may result in heat exhaustion, heatstroke,
   sunstroke, hyperthermia or hypothermia;
8. Spinal cord injuries which may render me permanently paralyzed; and
9. Travel to and from Activities.

 

C) Acknowledgement, Assumption of Risk, and Release of Liability

I acknowledge and agree:

1. That I have read this Agreement and fully understand its terms;
2. That I have signed this Agreement voluntarily, and that it is binding upon myself, my heirs, spouse, partner, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives;
3. The sole responsibility for my safety remains with me and I will remove myself if I sense or observe any unusual hazard or unsafe condition, or feel unable or unfit to safely continue;
4. To ASSUME all risks arising out of, associated with, or related to my participation;
5. To WAIVE any and all claims that I may have, now or in the future, against the Releasees;
6. To freely ACCEPT AND FULLY ASSUME all risks, including the possibility of personal injury, permanent disability, death, property damage, expense and related loss (including loss of income), resulting from my participation in the Activities of the Releasees; 
7. To FOREVER RELEASE AND HOLD HARMLESS the Releasees from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I may have or may in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Releasees.
