Release of Liability Waiver

I ACKNOWLEDGE that this “Waiver and Release of Liability Form,” will be used by the Experimental Sounding Rocket Association (ESRA), the State of Texas, the City of Midland, the landowner, sponsors, event supporters, and all personnel (collectively hereafter, “Released Persons”) for the International Rocket Engineering Competition (hereafter, “the Event”).

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Released Persons above from any and all liabilities or claims made by myself, or made by other persons on my behalf, as a result of my participation and actions in the Event such as, but not limited to, personal injury, illness, permanent disability, and death.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, travel expenses, or expenses, of any kind (collectively, “Claims”) that I may experience or incur and, I hereby release, covenant not to sue, discharge, and hold harmless the Released Persons above, including volunteer(s), sponsor(s), event supporter(s), event promoter(s), vendor(s), and each of their respective parents, members, partners, affiliates, divisions, subsidiaries, and landlords and their respective officers, directors, and employees from Claims of any kind arising out of or relating thereto.

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THE IREC AND ANY/ALL ACTIVITIES ASSOCIATED WITH THE EVENT AND THE EVENT ACTIVITIES, including, by way of example and not limitation:

I agree that the Released Persons are not at fault for any risks involving their own negligence, misuse, and carelessness. Examples include but are not limited to: property owned, maintained, controlled that can be dangerous or defective

I acknowledge that the Released Persons are not responsible for the errors, omissions, acts, or failures to act of any party or entity during the event.

I acknowledge that the activities in which I may participate in may challenge one’s physical and mental limits.

I accept all risks including but not limited to those caused by terrain, facilities, temperature, weather, condition of participants, rocket malfunction, unintended rocket descent into viewing areas, equipment, event traffic, condition of the surface, dehydration, and actions of other attendees.

I hereby agree that I shall not place my life or health in peril and consent to receive medical treatment in the event of injury, accident, and/or illness during my participation.

I agree to pay for all costs related to medical response, treatment, and transport on my behalf.

I certify that I am physically fit, have sufficiently prepared or trained for my participation in the Event or Event Activities, and have not been advised to refrain from participation by a qualified medical professional.

I certify that there are no health-related reasons or problems that preclude my participation.

I will govern my actions and responsibilities with respect to all activities which I participate in.

DRUGS/ALCOHOL

I certify that I am not under the influence of any narcotic, alcohol, or other drug that may impair my understanding or judgment. I will not at any time during the Event or Event Activities be under the influence of any narcotic, alcohol, or drug.

SMOKING

I understand that Smoking is not allowed inside any of the IREC facilities at any time. Smoking at the launch site (pads, prep areas, tents) is strictly prohibited. Smoking is permitted in the launch site main parking lot area ONLY.

PHOTOGRAPHY

I agree to be photographed and allow my photo, video, or film likeness to be used for any legitimate purpose by the Event and Event Activities holders, producers, sponsors, event supporters, and organizers.

POLITICAL ACTIVISM

I agree to represent my school and my country in a professional manner and demeanor. Flags or other forms of representation must be limited to your team, your university and your country. I understand and agree that any other forms of representation may cause offense to others and will lead to my removal from the event.

OVERNIGHT STAYS

I understand overnight stays are prohibited unless given
permission otherwise. ESRA is not liable or responsible for any property damage, theft, injuries, or deaths at any time.

This Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable Local, regional,
state or federal law.

I certify that I have read this document and fully understand its content. I am aware that this is a release of liability and a contract I signed at my own free will.
