Ozarks Regional YMCA Release and Waiver of Liability

In consideration for being permitted to utilize a facility or program of the Ozarks Regional YMCA ("YMCA"), I, agree as follows:

1. I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the YMCA, its directors, officers, employees, and agents (hereinafter referred to as "releasees") from all liability to me, my personal representative,s assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefor on account of injury to my own person or property or resulting in my death, whether caused by the negligence of the releasees or otherwise.

2. I FURTHER HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may incur arising from or related to my presence in, upon, or about the YMCA premises or participating in any YMCA program whether caused by the negligence of the releasees or otherwise.

I HAVE READ AND VOLUNTARILY SIGNED THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

This form is to stay on file at the center for a time no shorter than 3 years from the participation date.

YOU MUST BE 18 YEARS OF AGE TO USE THIS WAIVER. IF UNDER AGE 18, YOU NEED A PARENT TO FILL OUT THE WAIVER FOR YOU!

WAIVER AND RELEASE OF LIABILITY

This waiver is valid for one (1) year from the date signed.

In consideration of Ax Adventures And More LLC (hereinafter referred to as Ax Adventures And More LLC or Axe Adventures And More or AAAM) furnishing services and/or equipment to enable me, or the minor(s) I am signing for, to participate in Ax Throwing, Star Throwing or Knife Throwing I agree as follows:

I fully understand and acknowledge that; (a) risks and dangers exist in my use of Ax Throwing equipment and my participation in Ax Throwing, Star Throwing or Knife Throwing activities; (b) my participation in such activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of Ax Adventures And More LLC; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of Ax Adventures And More , or by any other person

I, ON BEHALF OF MYSELF, MY PERSONAL REPRESENTATIVES AND MY HEIRS, HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND AND INDEMNIFY AX ADVENTURES AND MORE LLC  AND IT’S OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES OR OTHERWISE WHICH MAY ARISE OUT OF MY USE OF AX, STAR, KNIFE THROWING EQUIPMENT OR MY PARTICIPATION IN AX, STAR, KNIFE THROWING ACTIVITIES. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS OR EMPLOYEES OF AX ADVENTURES AND MORE LLC.

MEDICAL PERMISSION AUTHORIZATION
If the participant is of minority age, the undersigned parent or guardian hereby gives permission for Ax Adventures And More LLC  to authorize emergency medical treatment as may be deemed necessary for the child named below while participating in Ax, Star, Knife Throwing activities from this date on.
I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE AX ADVENTURES AND MORE LLC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

I further agree that I have read, and will adhere to all Safety Rules for the Ax Adventures And More LLC Facility, and I have watched the safety briefing, either on line, or at the facility.

I understand that being unsafe in the playing area, either in front of or behind the throwing area, or removing any ax, stars, knife equipment,  or the violation of any of the other safety rules outlined in the Safety Training, is grounds for immediate suspension of playing privileges without any refund.

I understand that as a public facility, pictures and or video may be taken by Ax Adventures And More LLC staff or others, and I grant them the right to publish, and re-publish video, photographic portraits or pictures of me in which I may be included, in whole or in part.

I understand this is an Ax, Star, Knife Unit Only Facility, and no outside Ax’s, Star’s or Knives are allowed on the premises without prior permission from Ax Adventures And More LLC staff or others. I understand that outside Ax’s, Star’s or Knives will be confiscated without prior approval for use.  I agree that violation of any of the Ax Adventures And More LLC rules is grounds for immediate expulsion with no refunds.

FIRST BAPTIST SPARTA IS PROVIDING A SHUTTLE SERVICE.

If you ride the shuttle to the event, you must also ride home from the event.

The bus will depart from Sparta High School at 9:30 PM.
The bus will return to Sparta High School at 2:30 AM. Please have a ride waiting.
