I, the undersigned, understand and acknowledge that horse riding and associated equestrian activities is a dangerous activity and that horses can act in a sudden and unpredictable ways, especially if frightened or hurt.

I understand and acknowledge that serious INJURY or DEATH may result from horse riding activities and associated equestrian activities.  I agree that I RIDE / PARTICIPATE at my OWN RISK.

I understand and acknowledge the dangers associated with the consumption of alcohol or any mind altering drugs before and during the activity and I take full responsibility for any injury, loss or damage associated with their consumption.  I agree not to drink alcohol or take drugs prohibited by law whilst riding.

I also understand and acknowledge that I am responsible for any loss or damage to my own property or equipment.

I agree to comply with all directions, rules and safety requirements of Boneo Park, including any requirements relating to safety helmets, footwear and horse handling. I agree that I am solely responsible for ensuring that I wear a suitable safety helmet and footwear at all times whilst riding and take sole responsibility for my actions. 

1. Acknowledgement: I understand that Boneo Park supplies recreational services and that equestrian activities involve inherent risks which may result in Injury.
2. Release for Injury: To the maximum extent permitted by law (including s 139A Competition and Consumer Act 2010 (Cth) and, in Victoria, s 22 Australian Consumer Law and Fair Trading Act 2012 (Vic)), I release and hold harmless Boneo Park and each of its officers, employees, contractors, volunteers, instructors and agents (together, the Releasees) from and against liability for any Injury suffered by me arising from or in connection with the supply of the recreational services or my participation at Boneo Park, including if caused by the negligence or lack of due care and skill of any Releasee.
3. No suit: I agree not to sue any Releasee in respect of any such Injury.
4. Indemnity: I indemnify the Releasees against any third‑party claim arising from my acts or omissions while at Boneo Park, except to the extent the claim is caused by a Releasee’s Reckless Conduct or other liability that cannot be excluded by law.
5. Carve‑outs / savings: Nothing in this waiver excludes or limits:
(a) liability for significant personal injury caused by a Releasee’s Reckless Conduct (within the meaning of s 139A); or
(b) any other rights or remedies that cannot lawfully be excluded or limited (including under the Australian Consumer Law).
6. Definition: Injury means: death; physical or mental injury (including aggravation/acceleration/recurrence); or contraction/aggravation/acceleration of a disease.

I agree to comply with all Boneo Park Outdoor Arena and riding rules notified by Boneo Park from time to time, including the following:

(a)         riders approaching from opposite directions must pass left hand to left hand;

(b)         riders in walk give right of way;

(c)         riders performing diagonal changes / lateral work have right of way;

(d)         any horses behaving dangerously will be removed from the arena; and

(e)         all manure must be collected and removed from the Boneo Park Outdoor Arena promptly after your ride.

I acknowledge that Boneo Park may issue additional arena and riding directions at any time for safety, horse welfare, maintenance or operational reasons, and I agree to comply with those directions.

 

I acknowledge that, by attending Boneo Park and participating in equestrian activities, I may be exposed to infectious diseases (including COVID‑19) and that this risk cannot be eliminated.

I agree that I will not attend Boneo Park if I am unwell (including with cold/flu‑like or respiratory symptoms) or if I have been directed by a medical practitioner or a public health authority to isolate or quarantine, and I will comply with Boneo Park’s reasonable health and hygiene procedures and any applicable public health directions while on site.

 

In the event of a serious accident to horse or human, Boneo Park will contact Ambulance Victoria, or call for veterinary attention on your behalf. I acknowledge and agree that I am responsible for the costs of that assistance.

I understand that my signature to this document constitutes a complete and unconditional release of all liability of the proprietors of the Releasees, to the greatest extent allowed by law in the event of me and/or the children under my care, suffering injury or death.
