RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT Ottawa’s Strongest Man – A Foot Above Fitness WARNING: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING. BY SIGNING BELOW YOU ARE WAIVING IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZER AND ALL RELEASEES FOR NEGLIGENCE OR ANY OTHER CAUSE.

In consideration of being permitted to register for and participate in the event known as “Ottawa’s Strongest Man” (the “Event”), which includes but is not limited to strongman competitions involving deadlifts, log presses, atlas stone lifts, yoke carries, farmer’s walks, truck pulls, keg tosses, and all related training, warm-ups, equipment handling, spectator viewing, and any other activities organized or hosted by A Foot Above Fitness (the “Organizer”) at its premises in Ottawa, Ontario, I, the undersigned Participant (or the parent/guardian of the Participant if under 18), agree as follows:

Assumption of Risk

I fully understand and acknowledge that participation in the Event involves inherent and significant risks of serious bodily injury, permanent disability, paralysis, or death. These risks include, but are not limited to:
• Muscle strains, tears, or ruptures; joint dislocations, fractures, or spinal injuries;
• Falls from equipment or while carrying heavy objects;
• Equipment failure or collapse;
• Collisions with other participants, equipment, or structures;
• Overexertion, dehydration, heat-related illness, or cardiovascular events;
• Any risks arising from the negligence of the Organizer, its staff, volunteers, other participants, or any other person. I voluntarily accept all such risks, whether known or unknown, and I confirm that I am physically fit, have no medical conditions that could be aggravated by the Event, and am participating entirely at my own risk.

Release of Liability

I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby release, waive, and forever discharge the Organizer (A Foot Above Fitness, including its owners, directors, officers, employees, agents, volunteers, contractors, affiliates, and all other persons or entities acting on its behalf), the owners and occupiers of the premises, event sponsors, advertisers, and all other participants (collectively, the “Releasees”) from any and all liability for any loss, damage, injury, death, or claim of any kind whatsoever arising from or in any way related to my participation in the Event, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law under the Occupiers’ Liability Act and the laws of the Province of Ontario.

Indemnity

I agree to indemnify and hold harmless the Releasees from any and all claims, demands, losses, damages, costs (including legal fees on a substantial indemnity basis), actions, or proceedings brought by myself, my estate, any family member, or any third party as a result of my participation in the Event or any breach of this Agreement.

Medical Consent and Representation

I authorize the Organizer and its agents to obtain emergency medical treatment for me if I am unable to consent at the time. I agree to pay for any such treatment. I confirm I have adequate health, disability, and accident insurance and will not look to the Releasees for any medical or other expenses.

Governing Law

This Agreement shall be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ottawa, Ontario.

Severability and Entire Agreement

If any provision of this Agreement is held invalid, the remainder shall continue in full force. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements.

I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT CAREFULLY, FULLY UNDERSTAND ITS TERMS AND THE RIGHTS I AM WAIVING, AND SIGN IT VOLUNTARILY WITHOUT ANY INDUCEMENT.
