The foster cat shall hereinafter be referred to as “the cat” or "the cats". The aforementioned person shall hereinafter be referred to as “I” or the “foster parent.” Harrisburg Animal Rescue Team shall hereinafter be referred to as “HART”. Any cat offered for foster care is the sole property of HART and has been surrendered as such by prior owners or animal care facilities. To the best of HART’s knowledge, a foster cat is not the owned property of another person. However, HART will not be held liable for any unknown misrepresentations regarding the status of a rescued cat. The cat’s health and behavior has been accurately represented to the foster parent, to the best possible knowledge of HART. HART cannot, and does not, make any guarantees as to the health, temperament, mental disposition, or training of the cat. HART shall not be held liable for any illnesses or defects the cat may have or develop, or for any injury or damage that the cat may cause. The foster parent hereby fosters the cat at his/her own risk. I agree to foster a cat for Harrisburg Animal Rescue Team for a limited period of time. I understand that I am acting as a temporary custodian of any and all cats fostered for HART, and that HART retains sole ownership rights of any cat offered for foster care. I consent to the following terms and conditions of this foster agreement. I. General Care • I will care for the cat humanely. The cat will be a household companion and will live in the house. The cat will not be kept outside. • I will provide the cat with affection, mental stimulation through play and training, socialization, and regular exercise, appropriate to his/her health and physical condition. • I will provide the cat with good quality cat food and fresh water and maintain him/her at a proper weight. • I will provide the cat with comfortable and clean bedding, and appropriate toys. • I will perform the necessary tasks of clipping the cat's nails, brushing, and/or bathing (only when absolutely necessary) on my own during the time I foster the cat. If I cannot perform these tasks, I will inform the foster coordinator or the medical coordinator that I need assistance so that it can be provided. • I will advise HART when the cat needs to be groomed, and arrangements will be made. I will request HART's permission to groom the cat myself (other than bathing), or to take the cat to a professional groomer which has been arranged by the HART. • I will never leave the cat without proper care for more than 24 hours. • I will never leave the cat unsupervised/unattended in any vehicle. II. Health Care • I will contact HART immediately if the cat becomes ill or injured, and will seek timely veterinary care. I will provide a detailed description of the situation and a number where I can be reached. If my call is not returned within one hour, I will be deemed authorized to proceed with necessary treatment as recommended by Dr. Loop with Animal Medical Center (or another veterinarian if he is unavailable). • I understand that I will be reimbursed for any illness/condition not resulting from my care, if I provide HART with receipts for all services rendered. I understand that I will not be reimbursed for any injury sustained by the cat while in my care due to abuse or negligence. • I will not have any cosmetic surgery performed on the cat that will alter or change his/her appearance in any way, shape or form (i.e. ear cropping, tail docking, etc). • I will never breed the foster cat if he/she has not been spayed or neutered due to age or for health reasons while in my care. I will comply with all of the terms and conditions of the spay/neuter agreement. • I will not euthanize the cat without the approval/authorization of HART. I will notify HART immediately upon the death of the cat, and prior to the disposal of the body. III. Behavior and Training • I will use my best judgment and take all necessary precautions to protect myself when providing daily care and training for the foster cat until I have had sufficient time to become familiar with his/her personality and behavior. I will use my best judgment and take all necessary precautions when first introducing the cat to other members of my household and other family pets, as well as with new people and new situations until the cat has become fully adjusted to my home. I will closely supervise all interaction with children and dogs. • I will provide appropriate and humane behavior modification for behavioral problems including, but not limited to litter box accidents and urine marking, chewing, clawing, digging, aggression, and biting. I will contact HART if the cat exhibits behavioral problems that are beyond my ability to reasonably manage. • I will never use harsh physical discipline and will never physically abuse the cat. • I will never train or encourage the cat to behave in an aggressive manner for the purpose of protection. IV. Safety V. Follow-up • I will advise HART immediately if I plan to change my address and/or phone number. I will request HART's permission to transfer the cat to my new address. • I will advise HART immediately if the cat is lost or stolen, and make every reasonable effort to recover the cat, including, but not limited to contacting local shelters and veterinarians. • I will advise HART regularly as to the condition and adjustment of the cat. I will allow a HART representative to visit my home to check on the health and welfare of the cat and for the purpose of determining compliance with the terms and conditions of this agreement if deemed necessary. VI. Transfer of Ownership • I understand that I am acting as a temporary custodian of any and all cats fostered for HART, and that HART remains the lawful owner of the cat. I will surrender the cat to a HART representative within 48 hours if requested to do so for any reason. • I will never abandon the cat. I will never give, sell, or transfer ownership of the cat to another person, relative, rescue group, humane association, shelter or pound, pet store, or any medical or experimental laboratory or similar organization. • If I transfer the cat without the knowledge and approval of HART, I understand that HART will reclaim the cat from the transferee and will pursue legal means to do so if necessary and will pursue legal means to redress any harm done to the cat. • If I decide that I would like to adopt the foster cat I will advise HART and follow all adoption procedures. I understand that while I have been permitted to foster a cat this does not precipitate permission to adopt. I understand that HART makes the final decision regarding the adoption of this cat which is based on the best interest of the cat If I should be approved to adopt the foster cat, all further care, physically, medically and financially, will be solely my responsibility and HART will no longer pay for supplies, medical care, etc. VII. Return If I am no longer able to foster the cat I will contact HART immediately. Arrangements will be made within 72 hours for a HART representative to reclaim the cat VIII. Liability • I understand that HART cannot and does not make any guarantees as to the health, temperament, mental disposition, and training of the cat I hereby foster the cat at my own risk. • I fully and completely release HART, its members and volunteers, from any and all claims and liability, including, but not limited to, any defects or illnesses the cat may have or develop, and for any injury or damage to persons, property, or other household pets, which may be caused by the cat I further agree to indemnify and hold HART harmless against any and all claims and liability, including, but not limited to, those asserted by third parties for any injury or damage to persons or property caused by the cat • I certify that all the animals in my home are current in their vaccinations and heartworm prevention. I fully and completely release HART from all claims and liability for any illness that my animals might develop, even if said illness might have been procured from the cat fostered for HART. IX. Spay/Neuter Agreement • I will never breed a cat fostered for HART if he/she has not been spayed or neutered while in my care. I will take all necessary precautions to prevent a foster cat from breeding. • I will inform HART as soon as the cat is ready to for spay/neuter surgery, according to HART's protocol and standards set forth by HART's director in conjunction with the common medical practice of local veterinarians. I will be abreast of any changes to this protocol, and I will act accordingly. X. Promotion and Adoption of Foster Cat • I will provide the foster coordinator, or their helper, with a short biography and details about the cat, along with pictures and videos as soon as the foster cat is ready for adoption (determined by HART's protocol). • After the foster cat is ready for adoption, I will do everything in my power to attend at least one HART event a month with the foster cat. • I agree to stay in contact with the foster coordinator about the cat XI. I certify that I have never been convicted of animal cruelty, neglect, or abandonment by a court of law or other governmental authority. • I certify that I have read this foster agreement in full, and that I understand all of the terms and conditions. I understand that if I made any misrepresentation about myself or home environment, or if I don’t abide by all of the terms and conditions of this agreement and my failure to do so in any way jeopardizes or adversely affects the health and welfare of the cat that HART can terminate this contract for foster care and reclaim the cat without notice, irrespective of any expenditures that I have made, and may pursue legal means to do so if necessary. I understand that HART may pursue legal means to redress any harm done to the cat I understand that this contract for foster care is legal and binding and will be governed by the laws of the State of Pennsylvania.
