WAIVER AND RELEASE OF LIABILITY. READ BEFORE SIGNING. THIS IS A GENERAL RELEASE AND INDEMNIFICATION OF CLAIMS.

In consideration of being allowed to participate in any way in MVMNT Conference and related events and activities, the undersigned, either as the participant (if over the age of 18) or the parent or legal guardian on behalf of such participant (if under 18 years of age), agrees to the following:

I hereby release and discharge MVMNT Conference, Fresh Life Church, their parent companies, subsidiaries, and related companies, (herein after "Fresh Life or MVMNT Conference") and all Fresh Life officers, directors, employees, members, agents, volunteers, representatives, sponsors, contractors, agents, successors, and assigns (collectively, "Released Parties"), individually and collectively, from and against any and all damage (whether damage to or loss of property, finances, life, body, mind, or emotions), cost, suit, claims, demands, liabilities or other causes of action of any kind, except that which is the result of the gross negligence or willful misconduct of a Released Party, which arises out of or relate to my participation in, or my traveling to/from MVMNT Conference, including any damages, liabilities, or injuries arising out of the COVID-19 pandemic.

I am aware of the risks and hazards involved with attending MVMNT Conference, including but not limited to the hazards of COVID-19, travel by automobile or shuttle service, public rentals and hotels, recreation activities, the risk of injury, or even death. I hereby elect to participate in these activities voluntarily and, to the extent allowed by applicable law, assume full responsibility for any risk of loss, property damage, or personal injury, including death, which may result from my participation.

In the event of injury or a medical emergency, I understand that the leader of the church group which I am part of (any being a "Church Leader"), not Fresh Life, will be responsible for facilitating any necessary medical care. It will be the Church Leader's responsibility to assess medical needs, obtain and consent to appropriate medical care, transport persons in need of medical care, and contact parents or guardians of minors. I release Fresh Life and all Church Leaders from any and all liability related to medical treatment. In addition, I assume the risk and financial responsibility for any injury resulting from the attendee's participation in MVMNT Conference. I give my express, written consent to allow Fresh Life and/or any Church Leader to share the participant's personal and medical information in connection with any medical emergency or event.

I hereby further authorize and agree for Fresh Life to record and photograph (on film, tape, digital, electronic, or otherwise) me and to record my voice during my participation in MVMNT Conference. I hereby further authorize and agree to Fresh Life's unrestricted use, reuse, and distribution of said images and recordings, in whole or in part, whether in the original or modified form in any manner or media, including but without limitation to for purposes of advertising, promoting, and publicizing MVMNT Conference whether during the conference or at any time thereafter, in the sole and absolute discretion of Fresh Life, both in the United States and internationally. I expressly and irrevocably waive any and all rights I might otherwise have now or in the future to any related privacy or intellectual property rights, proceeds, benefits, or similar claims of any kind.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and health agencies recommend social distancing and other prevention guidelines to help reduce its spread. The best way to minimize the risk of contracting COVID-19 is to avoid contact with other persons. The undersigned acknowledges the inherent risks of COVID-19 in connection with person-to-person contact, which will be an inevitable part of MVMNT Conference. The undersigned agrees to abide by all preventative practices and measures instituted by Fresh Life or any Church Leader in connection with MVMNT Conference. Without derogating from any other terms of this liability waiver and release, the undersigned releases all Released Parties from any damages arising out of the transmission, contraction, or exposure to COVID-19 in connection with MVMNT Conference or any related activities.

This liability waiver and release contains the entire agreement between the participant, its parent or legal guardian(s), and Fresh Life and may be amended only in writing and signed by such parties. It is not intended to release the Released Parties from any conditions or activity that, as a matter of law, cannot be avoided, waived, or released, and no provision hereof should be so interpreted. It is governed by the internal laws of Montana (even if an applicable conflict of law rules would provide otherwise). Its terms are severable and shall not be strictly construed against any party.

I AM UNDER THE AGE OF EIGHTEEN (18) YEARS. MY PARENT/LEGAL GUARDIAN HAS READ AND COMPLETED THE SECTION BELOW.

I am the parent or legal guardian of the Participant for whom this document is signed. The Participant is in good health and sound mind. If necessary, I have discussed or will discuss with my physician the Participant's participation in the activity and the Participant has received or will receive any vaccination or other recommended prerequisite medical treatment my physician deems necessary. The Participant will participate in the Activity only if I have received my physician's approval, if I deem it necessary, and believe that the Participant is able to participate without harm. I acknowledge that the Church will not assess or approve the Participant's fitness for participation. I am under no force or duress of any kind to compel the Participant's participation in the Activity or my signing of this document.

I give my permission for the Student to be treated for illness or injury sustained while participating in the MVMNT Conference, including by the administration of emergency anesthesia or surgery, and authorize the adult leaders of Fresh Life Church to act on my behalf in ordering such treatment. Furthermore, such leaders are authorized to disclose any medical information provided to such person, Fresh Life Church, or any other representative of the MVMNT Conference if such person believes it is necessary in connection with any medical situation.

In the event of an emergency, the most accurate and updated information will be extremely helpful for us in providing the best care for your student.
