Hart-Cam Fitness Centre Inc.

Please consult your physician prior to starting any exercise or fitness program, and prior to using our facility.

I, the undersigned, acknowledge the inherent risks involved when participating in the programs offered by Hart Cam Fitness Centre Inc., of using any type of fitness equipment at Hart Cam Fitness Centre Inc., and in all other programs, sports and training activities relating therein. Accordingly, as consideration in exchange for being allowed to participate in any programs, sports, and/or training and other activities at Hart Cam Fitness Centre Inc., I agree to the following:

1. I acknowledge and fully understand that I will be engaging in activities that involve risk of serious injury, which may include permanent disability and even death, and severe social and economic losses which might result not only from my actions, but also from the action, inaction, or negligence of others, the rules of play, or the condition of the premises, or any equipment

used, and further that there may be risks not known to me or not reasonably foreseeable. I expressly assume all risks of injury, including death, which may occur in connection with my participation in activities at Hart Cam Fitness Centre Inc.

2. I agree that prior to participating in any activity at Hart Cam Fitness Centre Inc., I will inspect the facility area and all equipment to be used, and if, through my inspection, I determine that anything related to that activity is unsafe, I will immediately advise the Staff or another official of Hart Cam Fitness Centre Inc., of this unsafe condition and will not participate until this condition is corrected.

3. I agree to assume all the foregoing risks and accept full responsibility for my own damages following such injury, permanent disability, or death.

4. I hereby release, discharge and waive all rights to claim or action against Hart Cam Fitness Centre, its parent companies and any subsidiaries and all its respective agents, affiliates, associates, officers, directors, owners, landlords, and employees (collectively "Releasees") from demands, losses, or damages on account of any bodily injury, death or property damage caused or alleged to be caused in whole or in part by Releasees or any other party's actions, inactions, or otherwise. I also agree to indemnify Releasees from any and all third party claims caused in whole or in part by my actions.

5. I consent to emergency medical care and transportation in order to obtain treatment in the event of injury to me as Hart Cam Fitness Centre Inc., may deem appropriate. This Release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency.

6. I expressly agree that the terms of release and indemnity contained herein are intended to be as broad and inclusive as is permitted by the laws of the Province of Manitoba. Any provision or portion of this Waiver, Release, and Indemnity Agreement found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion. The offending provision or portion shall be construed to the maximum extent possible to confer upon the parties the benefits intended thereby. Said provision or portion, as well as the remaining provisions or portion hereof, shall be construed and enforced to the same effect as if such offending provision or portion thereof had not been contained herein.

7. I have been informed of the need for a physician’s approval for my participation in the exercise activities, programs, and use of equipment. I hereby assume all responsibility for my participation in said activities, programs, and use of equipment.

9. I agree to follow all current Manitoba Public Health Orders.

8. I understand that Hart Cam Fitness Centre Inc. is collecting certain personal information. I also understand this information will be used only for the purpose of administrating Hart Cam Fitness Centre Inc. memberships and programs. I hereby consent to such collection and use of this personal information.

9. I have read and understand the above Waiver, Release, and Indemnity Agreement and agree to its terms in full.

PATRONS ARE ONLY PERMITTED TO ENTER BETWEEN THE HOURS OF 6:00AM AND 11:00PM , DAILY.  PATRONS MUST BE OUT OF THE BUILDING BEFORE 12:00AM.  THE ALARM WILL GO OFF AFTER THIS TIME, NO EXCEPTIONS.

ALL NON-MEMBERS (DAILY DROP-INS) MUST SIGN IN, SIGN OUT.  AFTER BUSINESS HOURS DAILY DROP-INS MUST BE ACCOMPANIED BY A MEMBER AND PUT PAYMENT IN THE DROP BOX PROVIDED.

KEY FOBS MUST REMAIN IN THE POSSESSION OF PAID MEMBERS ONLY.

NO CHILDREN UNDER THE AGE OF 12 INCLUDING INFANTS & TODDLERS; AGES 13-15 MUST BE ACCOMPANIED BY AN ADULT MEMBER; MINORS AGE 15 MAY USE THE FACILITY WITHOUT SUPERVISION, IF THEY ARE IN THEIR 16TH BIRTH YEAR.(EX. APRIL THEY TURN 16, THEY MAY ATTEND WITHOUT SUPERVISION IN JANUARY) AGES 16-17 NO SUPERVISION REQUIRED;MUST BE 18 TO SIGN IN AS NON-MEMBER PAYING THE DAILY FEE. IF RULES IN PLACE ALLOWING MINORS TO USE THE GYM ARE NOT FOLLOWED, THE PRIVILEGES WILL BE TERMINATED. 

ALL PATRONS OF THE FITNESS CENTRE MUST FIRST SIGN A LIABILITY WAIVER, INCLUDING DROP IN NON-MEMBERS. 

NO STREET SHOES INSIDE THE GYM.  REMOVE OUTER FOOTWEAR.

RUBBER SOLED SHOES THAT COVER THE ENTIRE FOOT MUST BE WORN AT ALL TIMES.  FOR HEALTH AND SAFETY REASONS, SANDALS, SPIKED SHOES, WORK BOOTS AND FLIP FLOP TYPE OF SHOES ARE NOT PERMITTED.

WEAR PROPER ATTIRE. SHIRTS, SHORTS/PANTS MUST BE WORN AT ALL TIMES.  BATHING SUITS AND JEANS ARE NOT PERMITTED.  CLOTHING WITH ZIPPERS, RIVETS, SEQUINS ETC ON THE SIDES OR REAR ARE NOT ALLOWED AS THEY CAN DAMAGE THE EQUIPMENT.  CLOTHING WITH OFFENSIVE/VULGAR WORDING NOT PERMITTED.

OBSERVE PROPER PERSONAL HYGIENE BY SHOWERING REGULARLY, WEAR CLEAN CLOTHING AND USING DEODORANT.

CLEAN EQUIPMENT WITH SUPPLIED DISINFECTANT AFTER EACH USE.  PLEASE BRING YOUR OWN TOWEL.

 RETURN ALL EQUIPMENT TO ITS PROPER LOCATION OR STORAGE RACK.  DO NOT LEAVE DUMBBELLS OR WEIGHT PLATES ON THE BAR, FLOOR, OR LEANED UP AGAINST MACHINES.  IF YOU MOVE EQUIPMENT, PUT IT BACK WHERE IT BELONGS.  THROW YOUR GARBAGE IN THE TRASH CANS.

TREAT ALL EQUIPMENT WITH RESPECT. MISUSE OF EQUIPMENT CAN RESULT IN INJURY AND/OR DAMAGE TO THE EQUIPMENT; FOLLOW DIRECTIONS AND INSTRUCTIONS.  DO NOT SLAM/ DROP/ THROW DOWN WEIGHTS ON MACHINES OR DUMBBELLS/PLATES ON THE FLOOR.

PLEASE LIMIT USE OF ANY MACHINE TO 30 MINUTE MAXIMUM AT ANY ONE TIME WHEN OTHER PATRONS ARE WAITING.

NOISE LEVEL MUST BE KEPT TO A REASONABLE LEVEL. OTHER BUSINESS IS BEING CONDUCTED IN THIS BUILDING.  NO OFFENSIVE MUSIC, PLEASE BE COURTEOUS TO OTHER PATRONS WITH MUSIC SELECTION AND VOLUME LEVELS.

DISRUPTING OR INTERFERING WITH THE WORKOUT OF ANOTHER MEMBER IS NOT ALLOWED.  RESPECT THE RIGHTS OF OTHERS BY USING COURTEOUS AND APPROPRIATE BEHAVIOR.  PROFANITY IS NOT ALLOWED.  FIGHTING/ BULLYING/ INTIMIDATING; POSSESSION OF DRUGS OR ALCOHOL IN THE FACILITY ETC WILL NOT BE TOLERATED AND MAY LEAD TO AN IMMEDIATE SUSPENSION OF MEMBERSHIP PENDING A HEARING WITH THE BOARD OF DIRECTORS.   REINSTATEMENTS WILL ALSO BE PENDING A REVIEW BY THE BOARD OF DIRECTORS.

FOOD, DRUGS AND ALCOHOL ARE NOT PERMITTED IN THE FITNESS ROOM.  CLOSED, PLASTIC BEVERAGE CONTAINERS ARE ALLOWED.

THE HART-CAM FITNESS CENTER IS NOT RESPONSIBLE FOR PERSONAL BELONGINGS LOST OR STOLEN IN THE FACILITY.  PLEASE DO NOT LEAVE PERSONAL BELONGINGS BEHIND.

REPORT ANY DAMAGE TO THE RECREATION DIRECTOR OR BOARD   MEMBER IMMEDIATELY.

IN THE CASE OF A HEALTH EMERGENCY, CALL 9-1-1.

By signing below, I acknowledge that I have read, understand, and agree to the above Waiver and will abide by the Rules of Conduct for the Hart-Cam Fitness Center. I understand that failure to adhere to these rules may result in suspension or termination of my membership without refund. I also consent to the facility’s right to revoke my membership if I violate any of the stated policies.
