En acceptant la présente soumission, le client reconnaît accepter la portée des travaux, les exclusions, les prix, ainsi que les présentes conditions. L’acceptation peut être faite par signature, clic d’acceptation, courriel, message texte, bon de commande ou autorisation écrite équivalente, sous réserve des formalités impératives applicables au consommateur. Les travaux visent uniquement les composantes accessibles, visibles, sécuritaires et techniquement praticables au moment de l’intervention. Toute condition cachée, inaccessible, non déclarée ou découverte en cours de travaux pouvant modifier la méthode, la durée, l’équipement requis ou la portée du mandat pourra entraîner un ajustement de prix ou un avenant écrit avant exécution. Le client doit fournir un accès libre, sécuritaire et suffisant aux lieux, équipements, conduits, trappes, sorties extérieures, panneaux, locaux techniques et autres zones nécessaires à l’intervention. Les zones de travail doivent être dégagées avant notre arrivée. Tout retard, attente, déplacement inutile, impossibilité d’accès ou remobilisation causé par le client peut entraîner des frais additionnels raisonnables. Sauf indication contraire, Bel-Air n’assume pas les travaux de démolition, finition, plâtrage, peinture, reconstruction, ingénierie, analyses de laboratoire, ni la manipulation ou l’enlèvement de matières dangereuses, incluant notamment l’amiante, le plomb ou toute contamination nécessitant un protocole spécialisé. En présence réelle ou soupçonnée d’une telle condition, Bel-Air peut suspendre les travaux et facturer les frais raisonnablement engagés. Bel-Air s’engage à exécuter les travaux avec prudence, compétence et diligence. Toutefois, Bel-Air n’est pas responsable des défectuosités, bris, fuites, vibrations, corrosions, fragilités, non-conformités, odeurs persistantes ou pertes de performance attribuables en tout ou en partie à un état préexistant, à l’usure, à la vétusté, à une installation antérieure déficiente, à un manque d’entretien ou à toute condition hors de son contrôle raisonnable. Sauf mention contraire, le paiement est exigible selon les modalités prévues à la soumission. Tout solde impayé porte intérêt au taux indiqué à la soumission ou, à défaut, au taux légalement permis et applicable. Toute annulation ou tout report à moins de 48 heures ouvrables en résidentiel, ou à moins de 72 heures ouvrables en commercial ou institutionnel, peut entraîner des frais raisonnables de mobilisation, déplacement, réservation d’équipe, perte de plage horaire ou remobilisation, sous réserve des droits impératifs prévus par la loi. Bel-Air peut prendre des photos, vidéos, notes ou relevés avant, pendant et après les travaux afin de documenter l’état des lieux, la portée du mandat et la qualité de l’intervention. Ces documents demeurent la propriété de Bel-Air, mais le client peut les utiliser pour ses besoins internes, administratifs ou réglementaires. Aucune utilisation promotionnelle identifiable ne sera faite sans consentement écrit du client. Aucune disposition de la présente soumission n’a pour effet d’exclure les garanties légales applicables. En contexte commercial et institutionnel seulement, sauf faute lourde, faute intentionnelle ou limite interdite par la loi, la responsabilité totale de Bel-Air est limitée au montant facturé pour l’intervention concernée. À défaut d’entente contraire écrite, tout différend en matière commerciale ou institutionnelle relève des tribunaux du district judiciaire de Saint-Jean-sur-Richelieu.

Terms and Conditions of This Quote This quote is valid for the period specified in the document. Prices are in Canadian dollars, before taxes, unless otherwise indicated. By accepting this quote, the client acknowledges acceptance of the scope of work, the exclusions, the prices, and these terms and conditions. Acceptance may be made by signature, click-to-accept, email, text message, purchase order, or equivalent written authorization, subject to the mandatory formalities applicable to the consumer. The work applies solely to components that are accessible, visible, safe, and technically feasible at the time of service. Any hidden, inaccessible, undeclared, or discovered conditions during the work that may alter the method, duration, required equipment, or scope of the assignment may result in a price adjustment or a written amendment prior to execution. The client must provide free, safe, and sufficient access to the premises, equipment, conduits, hatches, exterior exits, panels, utility rooms, and other areas necessary for the work. Work areas must be cleared before our arrival. Any delay, waiting time, unnecessary travel, inability to access the site, or need for re-mobilization caused by the client may result in reasonable additional charges. Unless otherwise specified, Bel-Air does not undertake demolition, finishing, plastering, painting, reconstruction, engineering, laboratory analyses, or the handling or removal of hazardous materials, including, but not limited to, asbestos, lead, or any contamination requiring specialized protocols. In the event of an actual or suspected occurrence of such a condition, Bel-Air may suspend the work and bill for any reasonable expenses incurred. Bel-Air undertakes to perform the work with care, skill, and diligence. However, Bel-Air is not liable for defects, breakage, leaks, vibrations, corrosion, brittleness, non-conformities, persistent odors, or loss of performance attributable in whole or in part to a pre-existing condition, wear and tear, age, a previous defective installation, a lack of maintenance, or any condition beyond its reasonable control. Unless otherwise specified, payment is due in accordance with the terms set forth in the bid. Any unpaid balance shall accrue interest at the rate indicated in the bid or, failing that, at the legally permitted and applicable rate. Any cancellation or postponement less than 48 business hours in advance for residential work, or less than 72 business hours in advance for commercial or institutional work, may result in reasonable charges for mobilization, travel, team booking, lost time slots, or remobilization, subject to the mandatory rights provided by law. Bel-Air may take photos, videos, notes, or measurements before, during, and after the work to document the condition of the premises, the scope of the assignment, and the quality of the service. These documents remain the property of Bel-Air, but the client may use them for their internal, administrative, or regulatory needs. No identifiable promotional use will be made without the client’s written consent. No provision of this proposal shall have the effect of excluding applicable statutory warranties. In commercial and institutional contexts only, except in cases of gross negligence, intentional misconduct, or limitations prohibited by law, Bel-Air’s total liability is limited to the amount invoiced for the service in question. Unless otherwise agreed in writing, any commercial or institutional dispute shall be subject to the jurisdiction of the courts of the judicial district of Saint-Jean-sur-Richelieu.
