THIS EVENT APPLICATION AND LICENSE AGREEMENT (this “Application”) is made and delivered by the Applicant named and signing below to Visionary Ministries, LLC (“VisionaryMinistries”) for its consideration and requesting its approval of this Event Application and Contract based on the following information, which the Applicant represent to Visionary Ministries is true, complete and correct in all respects:

There is also an office onsite(326), which is not for Event use and which may be occupied and used by others from or authorized by Vision Ministries from time to time during your Event.

Deposit:

Deposit: At the time of submitting this Application, a non-refundable deposit of 50% must be paid to Visionary Ministries. The deposit will be credited towards the Event Fee or refunded if Visionary Ministries rejects this Application.
Additional Payment:

No later than 30 days before the start date of your Event, 50%, of the total Event Fee balance (including any Additional Charges), which will also be credited towards the Event Fee, must be paid to Visionary Ministries.
[1] This Application, if accepted, is intended by the parties to only be a license of limited duration and is subject to all of the terms and conditions of this Application, In no event shall it be construed as a lease or create a right of exclusive possession by the Applicant or others claiming by or through the Applicant. Visionary Ministries reserves the right to enter upon and use the Event site at all times, provided it does not materially interfere with the Applicant’s permitted use of the Event site. [1] There is also an office onsite, which is not for Event use and which may be occupied and used by others from or authorized by Vision Ministries from time to time during your Event.
Remaining Balance: No later than 30 days before the start date of your Event, the entire remaining balance owed must be paid, plus the Security Deposit and PROOF OF EVENT INSURANCE, both of which are described in more detail below.

Event Date Changes; Cancelations (No-Shows); Refunds:

Once scheduled, any changes you may want to make to your Event, including, but not limited to, changes to date(s) and time(s), must be approved in writing in the sole discretion of Visionary Ministries. If you should cancel or fail to show up for your Event at the scheduled date and time, the Deposit and all other amounts paid to Visionary Ministries on account of the Event Fee are automatically forfeited.
Visionary Ministries’ Right to Cancel:

Visionary Ministries reserves the right (but does not have an obligation or duty) to cancel an Event in whole or in part at any time if, in its sole discretion, it determines there are problems at or with the Event site which may cause issues or concerns for the safety of persons or property. In such an event, Visionary Ministries will endeavor to give you as much advance notice as is practicable under the circumstances, if any, and will determine the amount of refund, if any, which is fair and equitable under the circumstances. Visionary Ministries also reserves the right to cancel your Event if on or prior to the Event date, you or anyone acting on your behalf violates or causes any part of this Application to be violated. In such an event, the deposit and all other amounts paid to Visionary Ministries shall be forfeited. In no event shall Visionary Ministries be liable to the Applicant or any other person for any financial or other losses resulting from Visionary Ministries’ cancellation of an Event.
Smoking Policy:

The entire Event site, including the inside of all buildings, is non-smoking– No Exceptions. Smoking not only includes the use cigarettes, pipes and cigars, but also e-cigarettes, vaping, and similar products, and the use of any other tobacco product, including snuff and chewing tobacco.
Alcohol Policy:

Beer, wine, liquor and all other alcoholic beverages of any kind my not be consumed at the Event or anywhere on the Event site, and intoxicated persons are not permitted at the Event site – No Exceptions.
Vendor Policy:

If you plan to use caterers, entertainment and/or other vendors who may come on to the Event site to provide services or goods for an Event, you must ask for a list of Visionary Ministries approved vendors. To see if a vendor, who is not on the approved list, can be approved for the Event, please see __________ at least _____________ before the start date of the Event.
Cooking:

If you have signed up for use of the Café, it has non-commercial cooking facilities, which you may use to cook or reheat meals for your Event, for which it is your responsibility to clean and return to the condition in which you found it as part of you Event site clean-up obligations described below.
Parking:

Parking is permitted only in designated areas at the Event site.
The Lake:

There is a lake on the premises, which may be used for lakeshore fishing only – no wading. It may also be used for baptisms, but only if performed by a person who has been trained with the on-site baptism equipment and has been preapproved in advance of the Event by Visionary Ministries. BUT SWIMMING IN THE LAKE IS ABSOLUTELY FORBIDDEN.
Decorating:

Any decorating plans for your Event must be approved by Visionary Ministries at least ......... in advance of the Event. While the specific decorating for any Event will be reviewed and approved by Visionary Ministries on a case by case basis, the following are some general rules: (1) No nails, staples or tacks; (2) no spray paint or glitter; (3) no candles, lanterns or other open flames in or about any structure (tiki torches and luminary bags are permitted if at least 30 feet away from any structure or other improvement); and (4) no electrical work, remodeling or moving furnishings or fixtures other than tables and chairs.
Fireworks:

For the safety of all concerned, fireworks of any kind, including aerials, ground devices and novelties, such as firecrackers, M-80s and sparklers, are forbidden at or anywhere near the Event site.
Water and Sewer:

The Event site is serviced by on-lot water and on-lot sewer. Care must be taken to put only human waste, wastewater, and toilet paper into the on-lot sewer system so as to avoid blockages, damage to pumps and other system parts, and harm to the environment.
Event Site Clean-Up:

Visionary Ministries will provide you with an Event site which is reasonably clean and neat in appearance, and you are required to leave it in the same condition at the end of the Event. Set-up and take down of all tables, stacking of chairs and removal of decorations, gathering up and proper off-site disposal of trash, and the cleaning of all facilities used for the event are your responsibility. If you fail to do so, you will be assessed a charge for Visionary Ministries to do so or to have it done by a third party. NOTE: The Event site must be cleaned immediately following the Event. Clean up must be complete by 7 pm. on the End Date. This includes all décor, flowers, food, etc.
Damages and Repairs; Violations:

Applicant is financially responsible for any repairs, maintenance and replacements of anything broken or damaged during the Event by anyone at the Event Site other than Visionary Ministries. Applicant is also responsible for (and shall indemnify and hold Visionary Ministries harmless from) any economic or other damage, loss or harm incurred or experienced by Visionary Ministries resulting from a violation of any provision of this Application.
****** Insurance:

Event insurance with coverage of at least $1,000,000. is required to be submitted to and approved by Visionary Ministries prior to the Event as provided above. It must name Visionary Ministries as an additional insured and the policy or acceptable certificate emailed to HolylandofGodMolina@gmail.com and visionaryministries316@gmail.com. This is required in order to secure your reservation. In lieu of event insurance, Visionary Ministries will consider a commercial general liability policy or “All-Risk” policy meeting the foregoing requirements
ASSUMPTION OF RISK, WAIVER AND INDEMNITY (Read Carefully and initial at the end of each paragraph after reading it):

THE APPLICANT HEREBY ASSUMES ALL OF THE RISKS IN ANY WAY ASSOCIATED WITH THE EVENT AND USE OF THE EVENT SITE and accepts full responsibility for all damages, injuries and losses, including, but not limited to, such damages, injuries and losses resulting in disability, death, monetary loss (including attorney’s fees), and all losses arising from emotional distress or other non-physical injury (collectively, referred to as “Losses”), that may be sustained for any reason by the Applicant, its attendees or any other person or entity related in any way to the Event or at the Event site during the Event other than Visionary Ministries, except any such Losses caused solely by Visionary Ministries’ gross negligence or willful misconduct. The Client hereby grants the Company and its designated representatives permission to take and use photographs and/or videos of the event, its attendees, and any related activities for promotional, marketing, and documentation purposes. The Client acknowledges that these images and videos may be used in various media, including but not limited to print, digital, and social media platforms, without further approval or compensation. The Client also understands that any photographs or videos taken by guests, attendees, or other third parties during the event may be used in a similar manner by the Company, and the Client releases the Company from any liability arising from the use of such third-party content. If there are specific individuals who should not be photographed or recorded, the Client shall provide a list of their names to the Company in advance of the event to ensure their privacy is respected

APPLICANT ALSO PROMISES AND AGREES NOT TO SUE

Visionary Ministries or any of its members, employees, agents or other representatives, which are collectively referred to as the “Released Parties”, AND DOES HEREBY FULLY AND FOREVER RELEASE, WAIVE AND DISCHARGE the Released Parties with respect to any matter or thing in any way concerning or related to the Event, except any such matter or thing caused by Visionary Ministries’ gross negligence or willful misconduct. To the fullest extent permitted by law, Applicant EXPRESSLY INTENDS TO, AND DOES HEREBY AGREE TO INDEMNIFY DEFEND AND HOLD HARMLESS ALL OF THE RELEASED PARTIES from and against all claims, debts, demands, causes, actions, causes of action, suits, proceedings, losses, damages, cost, fees, including attorney’s fees, and all other liabilities of any kind whatsoever made or claimed against any of the Release Parties by any third party on account of any Losses he or she may have sustained or alleged to have sustained in connection with or related in any way to the Event or the Event Site unless caused by Visionary Ministries’ gross negligence or willful misconduct
