  • ENROLLMENT AGREEMENT

  • This is an agreement between Pacific Preparatory (a California private school) and the parent(s) named above, for one-on-one tutoring services provided to the student named above. The terms below describe what we provide and what we ask of you.


    A. Pacific Preparatory is a private school that provides one-on-one education services and works in collaboration with families, schools, and students. Pacific Preparatory shall provide education services in a variety of content areas and in learning-related skills such as study strategies, organization, motivation, and confidence. The Scope of Tutoring may be amended from time to time as agreed upon by the Parties.

    Pacific Preparatory’s Faculty
    Pacific Preparatory matches students with instructors who have been vetted through a thorough hiring process. All instructors hold a minimum of a bachelor’s degree and many hold specialized credentials and advanced degrees.

    B. Parent(s) wish(es) to engage the education services of Pacific Preparatory, and Pacific Preparatory wishes to provide such educational services to Student. Both parties wish to set forth their respective rights and responsibilities in this Agreement.

    WHEREAS, in recognition of the mutual terms and conditions set forth herein, it is hereby agreed to as follows:

    • 1. Nature of Agreement. 
    • The Agreement of the parties includes the provisions of this signed document, and any following Appendices (collectively referred to as the “Agreement”).

    • 2. Non-Solicitation. 
    • Parent or Student shall not, during the term of this Agreement and for a period of one (1) year immediately following the termination of this Agreement, or any extension of it, for any reason, either directly or indirectly solicit or attempt to solicit the services of any tutor(s) provided by Pacific Preparatory for their personal use or for any other person or entity with which Parent or Student has an association.

    • 3. Intellectual Property. 
    • Pacific Preparatory shall own all worldwide right, title, and interest in and to any intellectual property existing or created by tutor in the process of performing educational services under the Agreement. We may share first names and non-identifying photos of student work on our social media channels and in our school newsletters. If Parent(s)/Guardian(s) object to this use, please advise in writing as soon as possible.

    • 4. Term & Agreement Scope. 
    • a. Commencement.

      This Agreement shall commence upon the earlier of the first date on which Pacific Preparatory performed services or the date set forth next to the signatures of the Parties, or such other effective date as agreed to by the parties. To the extent that any work is performed based upon an initial verbal understanding, and that an eventual definitive written agreement is not executed, Pacific Preparatory is entitled to compensation for its work based upon the Session Rates set forth herein.


      b. Term.

      This Agreement shall continue in force between the Parties until the end of the academic school year unless sooner terminated pursuant to the terms of this Agreement.

       

      Either Pacific Preparatory or the Parent may terminate this Agreement for any reason upon delivery of a written notice of such termination. If there is any such termination, Parent shall deliver to Pacific Preparatory any outstanding monies due under this Agreement.

       

      e. Force majeure

      Pacific Preparatory is not responsible for delays or interruptions in services caused by events beyond its reasonable control, including emergencies, natural disasters, government orders, pandemics, or technology outages. In such circumstances, Pacific Preparatory will communicate with families and make reasonable efforts to resume services as soon as practicable.

    • 1. Tutoring Sessions. 
    • Tutoring sessions are sixty (60) minutes and can be reduced or extended at the Parent(s) or Student’s request, tutor’s schedule permitting. Parent(s) will be provided with regular updates on the Student’s progress via session notes provided by the tutor.

    • 2. Consideration. 
    • a. Extensions, Phone Tutoring, and Additional Meetings.

      In-person Tutoring Extensions (e.g. adding extra time to an existing tutoring session) and Phone or Online Tutoring are billed at the Direct Instruction Rate. Extensions to in-person tutoring and phone or online tutoring (live conversation between tutor and student) are billed in 1/4 session increments. Any phone tutoring session between the Student and Tutor that is less than 10 minutes is complimentary.

       

      E-mails between tutors and parents are always complimentary. Phone calls between parents and Pacific Preparatory staff that are less than 30 minutes are complimentary. Phone calls with tutors greater than 15 minutes will be billed at Direct Instruction Rates.

       

      From time to time parents may request that tutors or Pacific Preparatory staff meet with teachers, school administrators or other support personnel. These meetings may occur either in-person, on the phone, or online. Parents will be invoiced Direct Instruction Rate for these meetings with the Tutors (meeting lengths are billed in 1/4 session increments).

       

      b. Customized Tutoring Programs.

      Special arrangements will be made with Parent(s) engaging Pacific Preparatory in the provision of semester-long course work, home schooling programs or other customized tutoring programs that necessitate additional and/or ongoing preparation, evaluation and communication with outside parties including but not limited to teachers, school administrators, psychological/educational evaluators, psychiatrists, learning and behavioral specialists and other professionals. In such instances, Parent(s) and Pacific Preparatory will agree, in advance, to a rate of pay for these customized Tutoring Programs.

       

      c. No-Show Policy.

      If Student arrives more than fifteen (15) minutes late for a scheduled lesson that will be considered a No-Show. Tuition is not refunded for students who miss lessons. Whether any academic counseling is provided to Student during the remainder of the lesson time is within the sole discretion of the tutor.

       

      d. Invoices.

      Invoices will be sent on the first week of the month and will correspond to sessions held the previous month. They will be sent to the email address provided.

       

      e. Payments Due.

      All invoice payments are due upon receipt.

       

      Late payments on invoices will be assessed a thirty dollar ($30) late fee if payment on an invoice is not received within 30 days as a reasonable estimate of the costs necessary to compensate Pacific Preparatory for unpaid monies due. Late invoices will continue to accrue late fees for every successive thirty (30) day period that payment is not received.

       

      f. Use of AI Notetaking Tools.

      Pacific Preparatory uses AI notetaking tools to capture notes, action items, and summaries during meetings and calls. By signing, you consent on behalf of yourself and your representatives. Transcripts and summaries are stored within Pacific Preparatory's systems and are not used to train third-party AI models. You may withdraw consent anytime, in writing or verbally before any meeting, and we'll disable the tool. We'll confirm verbally at the start of each meeting and offer an opt-out. If you're bringing a third party, please ensure they consent or notify us in advance so we can disable the tool.

    • IN WITNESS WHEREOF, each party has caused this Agreement to be executed individually or by its duly authorized representative effective as of the date first written. By signing this contract I am affirming that I understand and authorize all of the above.
