MUSEUM USE, RELEASE, AND INDEMNITY AGREEMENT
FOR AND IN CONSIDERATION of the use of the property of OTTER COVE CHILDREN'S MUSEUM, LLC, a Minnesota non-profit limited liability company (the "Museum"), including but not limited to their facilities, equipment, art supplies, and personal property (the "Museum Property"), I, individually, and through my legal guardian, agree that I alone am responsible for my safety while participating in any activity on the premises of the Museum or using the Museum Property and specifically acknowledge that neither the Museum, the Governors/Board of Directors, nor any of their employees, agents, volunteers, guests, or invitees are responsible for my safety or the safety of my children while using the Museum Property. I specifically release and discharge in advance the Museum, the Governors/Board of Directors, and their agents, volunteers, and employees, from any and all liability, whether known or unknown, for injuries and illness caused to me, my children, guests, and invitees or my property and their property, even though the liability may arise out of negligence or carelessness of the Museum, their agents, volunteers, or employees, and I agree to accept all responsibility for the risks, conditions, and hazards, known or unknown, which occur in regards to my activities using the equipment or facilities of the Museum, including but not limited to injury, illness including but not limited to influenza and COVID-19 and related conditions.
I, or my legal guardian, understand and recognize that all gathering and play activities of children and related activities contain inherent hazards. That accidents involving children do happen, and that the complete sterilization of all Museum Property during active group play activities is difficult if not impossible. I, or my legal guardian, acknowledge that while the Museum has practices in place to limit injury, illness, contamination of surfaces and other safety hazards inherent in group play activities, no measures can completely eliminate them, and my use and the use of my children, guests, and invitees is with full acceptance and acknowledgement of those risks.
Being fully aware of these risks, conditions, and hazards of the group play activity, I hereby waive, release, and discharge the Museum from any and all claims for death, personal injury, property damage, illness, and accompanying medical costs and expenses which I, my children, guests, and invitees may have or which may hereafter occur to me as a result of my participation in events on the premises of the Museum or the use of Museum Property. I, or my legal guardian, further agree to forever hold harmless and to indemnify the Museum from all liability, loss, or damage for personal injury, property damage, illness, and accompanying medical expenses arising out of or in connection with my use of the facilities or equipment of the Museum, including all costs, expenses, damages, medical expenses and attorney's fees, costs, and disbursements.
Photographic Release: I grant and convey to OTTER COVE CHILDREN'S MUSEUM all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my children or my likeness or voice made by OTTER COVE CHILDREN'S MUSEUM in connection with my providing volunteer services (the "Materials") to OTTER COVE CHILDREN'S MUSEUM. I hereby authorize OTTER COVE CHILDREN'S MUSEUM's use of the Materials in their marketing and social media advertising in perpetuity and waive any and all rights of compensation or remediation for said use of the Materials.
